A draft bylaw regulating standards
for ATVs in the county received first
and second reading at county
council March 5.
Information from the county’s
engineer was discussed at the
February committee of the whole.
From that a motion was passed
approving the recommendation with
the costs to be included in the
highway department’s 2008 budget.
The county will adopt the
minimum maintenance standards for
ATV trails on county roads. In this
the highways department will patrol
designated ATV trails once a
weekend to check for conditions and
compliance with standards. They
currently do routine patrols of
county roads two times a week.
The minimum standard for should
drop-offs and wheel ruts on the
gravel shoulder will be those that
apply to county roads. If they reach
a depth of eight cm. the county will
grade the shoulder within four days
of discovery or reporting.
Currently the county does not
apply dust control to the shoulders.
However, it will be applied twice per
year to the gravel road shoulders for
which ATV travel has been
authorized under the bylaw.
Recommended signage for ATV
trails on county roads will be
identifying the areas, crossings,
speeds and bridges.
An agreement will be entered into
with the Maitland ATV Club after
which the bylaw will be given third
reading.
A sub-committee will be
established to mediate any
complaints, resolve conflicts and
provide direction for staff in
resolving ATV issues on sections of
county roads approved for ATV
trails. This sub-commmittee will
include two county councillors, the
clerk, an OPP representative, a
member of the ATV Club and a
representative from each of the
county’s planning and highways
departments. County engineer Don Pletch also
suggested that insurance premiums,
legal costs and claims
admininstration be kept separate
from the highways budget. His
department will track and monitor
maintenance-related costs
associated with the ATV trails on
county roads. Other budget
allocations could be assigned to
either the clerk/CAO’s departments
or to the claims administrator.
Estimated costs were reported to
be $33,200.
Councillor Ben VanDiepenbeek of
Ashfield-Colborne-Wawanosh said
that while he supported the club in
its endeavours he wondered if there
should be a review process included
in the agreement.
Chief administrative officer Larry
Adams said that they had debated
about whether to include one and
decided to leave it open. “This is the
first county bylaw of this kind. We
opted not to put a timeframe in so
we can react quickly to change it if
necessary.”
