Under cross-examination by
Crown Attorney William Coch-
rane, Carter admitted he had
driveri„the borrowed car "about
10 mileS" prior to the incident
and during that time had stop-
ped and started it at least three
times.
Counsel B. Menzies con-
tended there was no ciilpability
on his. client's part and that
under 'the circumstances of the
second car acting as tormentor,
"it would be unfortunate for
Carter to be convicted of an
offense of this -sort",
The youth admitted under
further cross-examination by
the crown attorney he had not
mentioned the second car to the
investigating officer at the time
he was being issued a summons
for the offense.
Magistrate Hays said Carter
had no 'quarrel "with respect to
the basic facts of the case . .
he did adinit he made more
noise than he' had to to negoti-
ate the curve. The tire marks
as described by the police indi-
cate a most unorthodox move-
ment of his car," he sa'i'd,'
The magistrate said although
he Was "highly suspicious" of-
the "theory put forward" about
the second car, but "I would
not want anyone convicted of
this or any other offense Where
one was a victim of a situation
that was -foisted upon them—
so to speak."
Dismissed Charge
He said had Carter told his
story to the police at the time
of the incident he would likely
have been believed and a charge
would not have been laid,
' "I'm not suggesting that the
story lacks any more credence
When 'given under oath," be
added,' commenting that the
witness "appeared- like a frank
witness. His failure to report
the other car at the time, how-
ever, makes me highly suspic-
ious of ;the degree of danger
to him at the time.
"However, I am lett with
Some doubt of Which I feel 'the
defendant should be the bene-
ficiaey. With some misgivings
I will dismiss this charge."
