FOR -RENT FOR RENT Tire -Squealing Charge -Dismissed -1Contintled from Page One). defence, said at the time be. was, trying, to elude, a car ...eon- 11(0470.11g SIX youths who had made ,an offensive rernarli to him and his female passenger At, a gasoline 01400111 and 1144 followed t6 the intersection of highways 4. arid 8, He said be was og. route to Seafortb, and was trYtOg to turn right fnern Victoria root to the .Segorth highway When the other car pulled up on th e 401.t side of iris vehicle preventing him from making,. `Oho turn. The youth said he backed up Victoria Street, and evade the left -turn down King Street be- cause he had seen police eras- ers. fihrkvd ,ov. the Cities .Ser, vice Station lot and hoped driv ing past them would shake off his unknown tormentor. He said the -tire squealing on the corner was caused because Ifewas ,ariving his brother's. car — a 1958 model — which bad more 'power than he was used to-,-ias the owner of a small Car. Under cross-examination by Crown Attorney William Coch- rane, Carter admitted he had driveri„the borrowed car "about 10 mileS" prior to the incident and during that time had stop- ped and started it at least three times. Counsel B. Menzies con- tended there was no ciilpability on his. client's part and that under 'the circumstances of the second car acting as tormentor, "it would be unfortunate for Carter to be convicted of an offense of this -sort", The youth admitted under further cross-examination by the crown attorney he had not mentioned the second car to the investigating officer at the time he was being issued a summons for the offense. Magistrate Hays said Carter had no 'quarrel "with respect to the basic facts of the case . . he did adinit he made more noise than he' had to to negoti- ate the curve. The tire marks as described by the police indi- cate a most unorthodox move- ment of his car," he sa'i'd,' The magistrate said although he Was "highly suspicious" of- the "theory put forward" about the second car, but "I would not want anyone convicted of this or any other offense Where one was a victim of a situation that was -foisted upon them— so to speak." Dismissed Charge He said had Carter told his story to the police at the time of the incident he would likely have been believed and a charge would not have been laid, ' "I'm not suggesting that the story lacks any more credence When 'given under oath," be added,' commenting that the witness "appeared- like a frank witness. His failure to report the other car at the time, how- ever, makes me highly suspic- ious of ;the degree of danger to him at the time. "However, I am lett with Some doubt of Which I feel 'the defendant should be the bene- ficiaey. With some misgivings I will dismiss this charge." • 4-BEDROOM HOUSE for rent in Clinton; oil furnace, garage, garden, good location, available now.
