H- ' Close, of Seaforth, for the amount of his claim and costs. It is the first time a decision on this particular matter has been given by the courts. In the Fifth Division Court of the County of Huron. . Between Elgin H. Close, Plaintiff, and the Corporation of the Township of Usborne, Defendants. R. Judgment—The evidence adduced before me established the following facts: On p.m., own weight 2 J. tons, on the cession of Usborne, on London. His wife front seat with him. along the said second concession of Usborne, they encountered a drove of twelve cattle, one of. which was on the left side of the road, grazing, the others being on the right side of the road. Then' contention is that this By­ law is under Si. S. 49 of -Section 397, Chap. 2'33, R.’S.O., 19 27 “for prohib­ iting or REGULATING the running at large or trepassing of animals Other than .dogs, etc." and that un­ der this section they may pass a by­ law allowing cattle to pasture on the ‘•Highway without anyone in charge, provided the conditions- of their by­ law are observed as they were in this ^ase. • - ‘ ■ In interpreting the Statute, t which the Defendant Corporation r lies iri this case, this Court must take into consideration all the> circum­ stances, customs and practices, af­ fecting the occurrence in question. The very language of the Section “REGULATING the running at large or trepassing animals” implies a rule or control of such animals, which was notoriously absent in this case. It is inconceivable that the Legislature would empower any Municipality to pass a by-law giving the right to anyone to place or al­ low a menace to ‘thp lives of the citi­ zens to wander unrestrained day or night on the King's Highway. I ■find that on a much travelled high­ way such as this was, the habit of pasturing cattle, on the highway is a direct and actual menace to the lives of people travelling ou such highways, and “The right of public to free passage along King’s Highway -is paramount.” is true that the legal estate in highway is vested in municipal (hority but only as a trustee for public, and the persons interested are all his Majesty’s subjects, whose right of free passage is by this means interferred with.” Code vs, Jones and Town of Perth, 5 4 O.L.R., 425 and Hydro Elec. Com. of Ontario vs. County of Grey 5 5 O.L.R., 344-5. Taking into consideration all the facts in connection with the case* and the above montoned authorities, I give judgment l’or the Plaintiff for the amount of his claim, with costs.
