The Motorized Snow Vehicles •Act, has, established a number of guidelines snow- mobile owners must follow. For example, knowingly or unknowingly trespassing on land while operating a snow- mobile makes the driver guilty of an offence, and on summary conviction, . ,he could be liable to' a fine not exceeding ..$500. _ Permission to operate a snowmobile on land other than your own must be obtained in writing, other- wise' you, could face a tres- passing charge. The owner or occupier of land owes no duty of care toward anyone driving or riding on a snowmobile or being towed by one, if the driver or rider is trespassing. The only duty the owner- occupier does have is not to create danger for snow- mobilers with the deliberate Wept- of doing harm or damage to the trespasser. LI4BILITY If someone else borrOws your snowmobile, with your consent, then you are jointly liable for any damages re- specting damage and injury resulting from the operation of the vehicle or for penalties for any breach of municipal or provincial bylaws _or re- gulations regarding motorized snow vehicles. Also, anyone driving a snowmobile on a highway or public trail must produce evidence that he is insured under a motor vehicle liability policy. HELMETS Helmets must be worn not only by the driver of a snowmobile, but also' .by passengers and by anyone being towed behind a snow- mobile on a cutter, toboggan or sled. Helmets must comply' with the same standards established for Motorcycle, helmets.. ' TOW BARS If a snowmobile operator is going to tow a cutter or toboggan behind this machine, he must use a rigid tow-bar. Towing is pro- hibited on a serviced road- way, except to cross the road at. a -90-degree angle, - This rule doesn't apply to a snowmobile which is being used to free a stuck vehicle or conveyance or for an emergency rescue or trail maintenance. Snowmobile drivers who must use the highway are used to be particularly care- ful on ice, packed snow or dry roads since the vehicle's steering and braking systems aren't designed for this kind against which common /sense precautions should be taken.
