AOAINsT TUE TOWN -Honorable Mr
Justice Teetzel,who held' the Assizes
in Goderich last week, gave judgment
in the action of Miss Sangster against
the town for ' damages sustained by
falling into a hole in one Of the streets*
He awarded damages of $000 with
costs. On the street where the ac-
cident occurred, however, there never
was a sidewalk constructed, *and the
defence to the action was that the
roadway for horse and carriage traffic
was all that was required for the
street and that a pedestrian was not
entitledto expet the road to be level
from fence to fence. At a meeting of
the town council. it was decided. to ap-
peal the case. At the trial the j udge
expreesed the opinion that the ease
was one where the opinion of an appel-
late court might be obtained for the
purpose of having a decision on cases
of this kind,there apparently being. no
decided Canadian case on this point.

Y.P.A. in connection with St. James'
Church was held in the basement of
the church on Friday evening last,
'There was a large attendance of
mem-
bers and friends. The Rey. W. H.
Dubber opened the meeting in the
usual way, after • which Mr. Fred
Middleton, president, explained that
the meeting was to take the form of a,
contest,'. the A. Y. P. A. having been
dieided Into twoildes, each side having.
provided an excellent program. Oon-
sidering this, Mr. Middleton. did not
wish to occupy thele time, and calla
upon the, pestor to occupy the chair.
