The report of the Higgerson-Ryan Municipal Drain was read and provisipnal- ly adopted. The Mulholland Drain report was read and the engineer, James A. Howes, not being present to answer some of the ratepayers' questions, the report was held over until he could contact them. The treasurer reported the balance of, the 1962 road sub- sidy had" been received, $21,669. The gravel contract was award- ed to John Murray Construc- tion, Moorefield, for 65c per yard, subject to approval of the Department of Highways. The meeting ad- journed to meet again 11Ionday, April 1, at 1 p.m. USBORNE COUNCIL In a sequel to a recent court case here; Usborne council Mon- day agreed to pay claims for damages by dogs to sheep and to take steps to order the dis- position of a particular dog which has been worrying a flock. The action resulted from discussions with R. D. Ether- ington. who claimed damages, and livestock valuer Harry Coates. Council agreed to pay an earl- ier claim but requested Mr. Etherington to allow time to consult the veterinarian called in by council to investigate the condition of the animals in a further claim. Mr. Etherington agreed but made claim for flock damage of unstated amount. The livestock valuer made a written report to council that in his opinion, as of March 1, there was no flock damage. Mr. Etherington was given a copy of the report and was examin- ed by council as to his knowl- edge of the ownership or locale of the dog alleged to be lately worrying his flock. - Mr. Etherington made a writ- ten statement to council in sup- port of his evidence concerning the owner or harborer of the guilty dog and council approv- ed a motion "that steps be tak- en to notify the alleged owner that the dog was worrying sheep and should be disposed of." Council appointed Allan Flet- cher and Hubert Hunter as war- ble fly inspectors for 1963, to be paid at the rate of $1.10 per hour and mileage at township rate while engaged in duties. .With no appeals against it, the Keller municipal drain by- law in which Exeter property owners are involved, was given its final reading. A complaint from Gerald Prout about the condition of the Taylor municipal drain was accepted and referred to En- gineer J. A. Howes, OLS, Lis- towel, for a report. W. H. Westlake's complaint about .stoppage of the tile por- tion of branch one of the Cann - Mitchell drain was accepted al- so and referred to Howes for advice about repairs. A by-law setting the 1963 road budget at $48,000 was ap- proved, It includes $20,000 for construction and $28,000 for maintenance. Reeve George Frayne presid- ed and all councillors were pres- ent. Next meeting will be held April 2. MORRIS COUNCIL George Radford Construction Limited, Blyth, was awarded the contract for supplying, crush- ing and., hauling of gravel in Morris Township. The tender of 71 cents was the lowest of three tenders received and consider- ed by Morris council Monday at their regular meeting. Highest tender was 77c per yard. Court of revision on the Hig- gins Drain was set for May 6 at 2:30 p.m., following the con- sideration of the report by council. CIerk Mrs. Helen D. Martin was instructed to pre- pare and deliver by-laws on the drain. Thursday of George William Garniss, 84, of Blyth, in Huronview Home, Clinton. Mr. Garniss retired 20 years ago as a carpenter in Blyth. He leaves two sons, Leslie, Wing - ham, and Harvey, Blyth; two brothers, Jack, Toronto, and Charles, Regina, Sask., and one sister, Mrs, Annie Elliott, also Regina. A funeral service was held Saturday at 2:30 p.m;., in the Tasker Memorial Chapel, Blyth. ALBERT FRANK LAYTON Albert Frank Layton, 81, Clin- ton, died Wednesday in Clinton Public Hospital. Born in Aur- ora, Mr. Layton was a Tucker - smith Township farmer before moving to Clinton in 1921, where he became a service sta- tion operator. He was the son of the former Mr. and Mrs. Frank Layton and a member of Ontario Street United Church, Clinton. Mr. Layton leaves his wife, the for- mer Mary Louise Pepper; one son, Elliott, Tuckersmith Town- ship; three brothers, Walter, Bayfield; John, London,, and Charles, Toronto; and one sis- ter, Mrs. Fred Pepper, Clinton,' and thi°ee grandchildren. A funeral service was held at the Ball and Mutch funeral'' home, Clinton,.Saturday at 2x00 p.m., with burial in Clinton Cemetery. On approaching the railway crossing, half a mile east of Blyth, Mr. Wasson heard, the warning bell sounding, He im- mediately pulled his car into the snowbank on the roadside, but icy conditions caused the car to swerve and slide back- wards against the train.
