LAND USE PURSUANT TO SECTION 34 OF THE
PLANNING ACT,1983
TAKE NOTICE that the Council of the Corpora-
tion of the Town of Seaforth has passed By-law
#46-1983 on the 29th day of November, 1983,
under Section 34 of The Planning Act, 1983.
The following schedules are attached hereto:
1. Schedule 1, being copy of By-law 1146 1983.
2. Schedule 2, consisting of the following:
i. An explanation of the purpose and effect of
by-law.
ii. A key map which shows the location of the
lands to which the by-law applies.
ANY PERSON INTERESTED MAY, within
thirty-five days from the date of the passing of the
by-law, appeal to the Municipal Board by filing
with the Clerk of the Corporation of the Town of
Seaforth a notice of appeal setting out the
objection to the By-law and their reasons in
support of the objection. j

Where a notice of appeal has been wed with the
Clerk of the municipal' within the time provided,
the by-law shall b submitted to the Ontario
Municipal Board d the by-law does not come
into force until al of such appeals have finally
been disposed of where upon the by-law, except
for such parts thereof as are repealed or amended
in itccordahce with the direction of the Municipal
Board or as are repealed or amended by the
Municipal Board or by the Lieutenant Governor in
Council, shall be deemed to have come into force
on the day it was passed.

A BY-LAW TO AMEND BY-LAW NUMBER 794
WHEREAS the Municipal Council of the Corpora-
tion of the Town of Seaforth deems it advisable to
amend Zoning By-law Number 794 as amended,
NOW, THEREFORE, The Municipal Council of
the Corporation of the Town of Seaforth ENACTS
as follows: ....
1. By-law Number 794 is hereby amended by the
addition of Section 4.11 as follows:
"Where a lot having a lesser lot area a d/or lot
frontage than required under this b -law is
held under distinct and separate ow ership
from abutting lots as shown by the registered
conveyance in \ the Registry or Land Titles
Office at the date of the passing of this By-law,
or where such lot is created by expropriation,
such undersized lot may be used and a building
or structure may be erected, altered or used on
such undersized lot provided all other
requirements of this By-law are complied
with".
2. This By-law shall come into effect pursuant to
Section 34 (19) of The Planning Act, 1983.

BY-LAW NO. 46-1983
i. By-law No. 46-1983 has the following purpose
and effect.
The purpose of By-law 1146 of 1983 is to amend
By-law Number 794 by the addition of a general
provision enabling the erection , alteration or
use of a building or land on existing lots having
less than the required frontage and/or area,
provided that all other requirements of the
zoning by-law are complied with.
Section 5.2.1 of By-law Number 794 is a similar
provision for residential zones only. The
addition of 4.11. in the General Provisions
Section permits the same for lots in other
zones.
ii. A Key Map is not required in this by-law as this
general provision applies to all properties
within the Town of Seaforth.
