You and T have no 'constitutional rights', except those we are granted by parliament .. such as Part II of the constitution: 'The Charter of Rights and Freedoms'. Govern- ment leaders can withdraw these rights at will. Constitutional law is the supreme law in Canada! Constitutional laws can be likened to rules that regulate team competition, whereby society is viewed as one team, and our governments the other. The Supreme Court of Canada acts as the referee. The processes by which constitutional law is made. are seriously flawed. Since 1987, ociety has .been excluded from par- ticipating in making new constitutional law. That right is reserved for our government leaders. Society cannot materially debate, nor affirm constitutional laws propsoed by government leaders. After the Accord was announced by the Prime Minister, he said: 'there is no reason for Canadians to debate the Accord'. This process is archaic, feudal undemocratic! It confines excessive power and authority in the hands of our political leaders. Society itself must play the critical, and pivbtal role in constitutional law ... law that it, politicians, governments, and the Supreme Court of Canada must follow, and obey. The Canadian Constitution is far too important to society, and our children, to be left to the exclusive control of politicians. Under Part II of our constitution, in- dividuals and groups are guaranteed cer- tain 'rights and freedoms'. As a result of ex- clusive political control of our constitution, politicians can deny society 'rights and freedoms' with impunity, as the following example proves. In 1982, our political leaders constructed a constitutional amendment, article 33: the 'notwithstanding clause'. It gave govern- ments constitutional authority to deny (sus- pend) 'rights and freedoms' to individuals, or groups, whenever political objectives re- quired it. Quebec declared itself a 'French Language only' province, under Quebec Bill 101, in the late 1970s. In late 1988, the Supreme Court of Canada ruled that parts of Bill 101 denied minorities use of their 'language rights', which were protected under both the Quebec 'Charter of Rights', and Part II of the Canadian Constitution. In effect, the court ruled that the Quebec Government had exceeded its constitutional authority. In early 1989, as a way of sidestepping the court ruling, the Quebec Government decid- ed to ignore its own Provincial 'Charter of Rights', and Part II of the Canadian Con- stitution, by passing Bill 178. Bill 178 con- tinues to deny 'Minority language rights' ... including English. Also, the Quebec Govern- ment invoked article 33 of the Canadian Constitution. • Under article 33, neither individuals, nor groups, can petition the courts to overturn this type of political decision. There is no recourse to article 33. Once invoked, all legal arguments cease...Bill 178 is now law in Quebec. This is democracy, Canadian style, under the rule of existing constitutional law, law that only politicians can agree to: Today, society is denied 'minority language rights' in Quebec. Tomorrow, what will tomorrow bring in Quebec ... other provinces? It's becoming more and more difficult to distinguish Canadian Constitutional pro- cesses from those in countries led by autocratic governments. Where does it all end? Politicians would have society continue to believe that there is no need for massive public input to constitutional processes. Because we practice indirect parliamentary democracy, society is in fact the ultimate power in Canada, through the electoral process. By this argument, politicians would also have society believe, tMt,it is.somehowvir- tuotts• for society to play an inconsequential, after -the -fact, reactionary role to their con- stitutional proclamations. Canadians are not deserving of this type of condescending treatment from their political leaders. Society must press for new constitutional processes! For almost a year, the Constitutional Guardians of Canada (CGC), has been pro- moting 'society's right' to control all con- stitutional processes, in various sectors of society. It contends that society cannot pro- perly shape the fundamental character of the nation its children will inherit (our na- tional identity), when cut off from all con- stitutional processes. Canadians have proudly built a tolerant, caring society. On occasion, they have taken time to aggressively demonstrate their disapproval of constitutional violations in other countrie`t....some of which characterize themselves as democratic. However, for 121 years Canadians have never been willing to look inward, to face the deficiencies of their own constitutional environment ... to strive for full participa- tion in all constitutional processes. Canadians must play a more active and pivotal constitutional role. Our 'constitu- tional rights' are being eroded. What will be left for our Children to inherit?
