A Lawyer's Opinion of the Fence
Question. •
• A enainent Canadian lawyer is said to,
have given his opinion lately, which if
proven to be correct, will revolutionize
a large portion of munieipal law, says
an exchange. 11 18 in short that the
owners of cattle doing damage to prop-
erty are lialsie,no matter what condition
the fences are in or indeed whether
there is afence at all. This opinion is
not without reason. If Smithowns an
unfenced field and sows it with grain
and Jones' oattle come and eat it up
surely it is not unreasonable to say that
Jones ishould foot the bill, if he choose
to have cattle he should keep them on
his own property. He has no more
right to go free of damages because of
there being no fence around the field
than a thief would after robbing a house
because the door was off its hinges.
