I thought it best to consider the merits that 1 might determine whether or not it was a proper case for the exer- cise of such discretion. I have come to the conclusion that this is not. a case in which I should assist the plaintiff. Even if I had found that the plaintiff had a right to hind the bay by the agree'lient in question, as the amount here claimed is for the benefit of the boy whose duty it was, to fulfil the contract by remaining his full terns, I do not think that as a matter of equity and good conscience, that the plaintiff should suceee-i on the facts disclosed here. It was not the defendant's fault in any wiry that the boy did not, fulfil his contract, on the contrary, the boy left the defendant because he doubted that he would get the $200, covered by the contract frorn the plaintiff, or the Horne, in case he fulfilled his term with defendant. The defendant lost the services of the boy for the most valuable portion of his' term whilst the boy was earn- ing, and getting wages elsewhere.
