The trial of James Carroll for the lewder of Judith Donnelly came to a close on Saturday night, after having lasted tete whole week. The jury, after deliberatingfor over four hours, failed to agree:a.nd were discharged. His Lordship reviewed the entire ease with `melt care, and drew conclusions from the testimony which, as readers of the speech \'ill observe, were by no means fevorable to the prisoner. The jury, .Who we:rt_ into the box for the sixth tiro at eine in the morning, sat listen- jltb to tl-e evidence in rebuttal and the addresses until 4.30, when they retired to dismiss the verdict. Having had no food since morning, being unable to gree, and nut receiving their discharge anti? half -past ten o'clock at night, they were very much fagged out when they re -appeared in court. Their fa- tigue was, however, as nothing cam - pared with the evident anxiety of the prisoner, who, when the trial was com- menced, had sone show o2 confidence in his chances of getting off, bat who, by the time His Lordship bad conclud- ed his addess to the jury, gave lnmis- takable signs of a change of opinion in that regard. - The following is a synopsis .of the Judge's charge,. which tided very strongly, all the way through, against the prisoner. The first part referred to TIIE VIGILANCE COMMITTEE.. Reyes only by acts of the or- ganization` that the. purposes of its founders could be arrived at. It was, of course. lierfectiy legitimate to en- deavor to find out crime and bring peo- ple to justice ; bat organizations - such as this were clearly outside of the law. They were not recoguizea. by the law. They were the frequent mothers of all sorts of offences. Such organizations, When formed to bring people to the law, frequently, when failiug in that purpose, took the law into their own hands. The particular • depredations Which called the society into existence had not been given, but the acts of the society subsequently showed- its char- acter. In several matters it had pur- sued the Donnellys. When it should have got diem bound over to - keep the ' peace in the case of Thonlpson's cow, the zeal its members showed in sitting tip all night and descending upou the Donnellys in a large band in the morn- ing showed its promptitude to act and its readiness to judge of a charge with- out first enquiring into it. Had these men for their attack on the Donnellys been indicted for richt instead of being charged with a trespass, the indictment would undoubtedly have been sustain- ed.
