A Charge of Child Steali-ng
On Tuesday, at the Cobourg Assizes,
a somewhat novel case, for Canada, was
tried, that of a, Mr. Goodwin for the ab-
duction of two children. As a rule in
this country men are not so fond of
children as to steal those of other peo-
ple -for their OWIl use. Mr. Goodwin is
not an exception to the rule, the theft
in this case not being committed.

tion arose •out of that frequent cause
of thssension and. trouble, sectarian dif-

and Mrs, Keith., whose r ames were once
before prominently before the country
in connection with their family and. re-
ligious di,sputes. Some eight year ago
the samel children (now aged ten and
twelve respectively) were taken away
by the mother in order to be educated
in the Roman Catholic faith. They-
-were afterwards returned, and for pro-
tection against the mother were made
wards in Chancery, the mother consent-
ing to the arrangement on provision for
her separate maintenance being made,
and it being agreed. that she should be
allowed to visit them a certain num-
ber of times every year. Two other
children, it is understood, were sent to
Scotland. The agreement on Mr.
Keith's part appears to have been faith-
fully kopt, he regularly paying to his
wife her maintenance, and allowing her
to see the children twice its often as had
been agreed upon. But the mother was
not satisfied, and filially the present
charge of child stealing arose against
Mr. Goodwin under the following cir-
cumstances, as proved before the court:
Mr. and Mrs. Keith's children were un-
der the care of Rev. Kr. Drummond, a,
Presbyterian minister, of Newcastle,
and Mrs. Keith—a Roman Catholic,
who is separated from her husband,
who lives in Toronto and is a Presby-
terian—received maintenance from him,
but on the condition that the two boys
sb.ottld be left under Mr. Drummond's
care. Mrs. Keith was allowed. to see
them but not -.10 have them. On March
12th the boys, James and John, did not
return from school, but were abducted
by the prisoner, Mr. Goodwin, who
hired two buggies at Whitby and drove
with them to NeWcastle, where he was
accompanied by Mrs. Keith. The
father being a Protestant, desired to
have the children brought up in that
faith, and, tb.e mother being a Roman
Catholic, wished to have the children
brought up in her faith. The object in
the case was not to steal any article
from the children, but solely to take
thein away. The evidence showed that
the mother was with Mr. Goodwin
when the abduction took place, and it
did not show that any violence was used
towards tb,e children, they appearing, to
be quite content to go , with their
mother. In the absence of any proof of
violence being employed by Goodwin,
and it being clear that he acted under
the mother's instruction, the jury dis-
agreed. The two boys, it is understood,
are now in some Ronaan Catholic in-
stitution in the States, where, out of
the father's reach, they are to be brought
up in that faith. Mrs. Keith in court
did not deny that she knew where they
had beeu placed, but positively refused
to tell.
Legally, Mr. Keith is, no doubt, en-
titled to the charge of the children un-
der the direction of the Court of
Chancery, whose wards they had been
made. Bat, thiougb. there can be no
doubt that the 'abduction was, in the
kgal sense, an outrage on the rights of
the male parent, yetit may be fairly
enough held that in such a case the
mother has some rights as well, even
though the law does not recognize
them. It is true that, in taking them
away as she did, she broke the promise
she made when she consented to part
with them as one of the conditions of
receiving an annual sum of money from
Ur. Keith for her separate mainten-
ance. In doinebso she has probably for-
feited the right to that payment. But
beyond that breach of contract—a con-
tract into -which she doubtless entered
unwilliugly—it is difficult to see what
censure she is deserving of. Her re-
ligious convictions as a Catholic are
equally_strong with those of her hus-
band as a Protestant. According to the
amiable dogmas of the creed she, as a
Catholic mother, is bound to believe
that if her boys aro brought up Pro-
testants; they will lose their souls ; he
on the other hand, as a Protestant
father, has to believe that if his sons
are made Cath,olics of, their everlasting
damnation is certain. Each of them is
Eghting for the souls of the children,
and each is equally convinced_ that the
triumph of the other means the eternal
misery of their sons. it is the battle of
two earnest and sensitive consciences
over the souls of their own offspring,
and no inatter which one we may think
right, we must yield. respect to the con-
victions of both. The father has the
law of the land on his side, but in th,e
court of conscience the mother's right
to guide -the destinies of ' her child are
uo less strong than those of the father.
It is not possible to honestly censure
either for what they are now 'doing, but
the very struggle in -Which they are en-
gaged shows how much they wronged
each other and how great a wrong they
were preparing for their children, when,
With such antagonistic religious views,
they consented to become man and
Wife. Either those whose Christian
faith is merely nominal, or those whose
faith is so broad as to erabrace as Chris-
tians all who belong to any Christian
Church, may try the perilous experi-
ment that Mr. and Mrs. Keith_clid. But
those who believe that salvation is only
to be had within their special sectarian
fold, hita better marry within that fold,
or else be prepared to look forward to a
struggle, by which, whichever wins, the
ether will have to endure the agony of
believing that the victory, has been won
at the cost of his or her child's eternal
