throw him a revolver over the gaol

me the crime was committed about
12 o'clock, and he said he was guilty,

getting clear, and wished me to get
some of my friends swear that he
was not there. He said that he would

picious of him. 'Went to Xelipe's on -the al-

amined the pans out iide the house.
• Mr. Core.—Was with Trainer at the time
of getting the pants, and found a piece of pa-
per, an o_d purse and shot in the pocket.

pockets- corresponded with that found by Dr.
Vercoe in the body.

Thos. Stephens.-74m a constable. Was
called in connection with this murder on
Sunday evening, Went to D. Donnovan's
on Monday and found the socks, pants,
shirts, and some trades of some, kind of
cioth in the stove. Was at Division Court
when oi'd Melady and the prisoner. had a
suit. At thae time Nicholas made some
statement to the effect that if the old man
beat him, then he would beat him again, .
Dr. COlenta9? recalled.--L-There was an account
found with the book, and. afterwards recog-
nized by Mr. MeeMulkin.
C. 11. Cull.—Am the Express Agent at
Scaforth. Sent the hat now produced to
Dr. Croft. It was sealed in my presence.
Mr. Gemmel recalle .—FouNd the book.
handed it to Grant, and from Grant to Dr.
Vercoe, Saw it in Dr. Coleman's possession
15 minutes after its being found.
• Mr.- Grant recal!el. —Mr -Gemmel handed
me the book, and. I to Dr, Vercoe.
_Mr Trainer recalled. —Testified further as
to getting possession of the book. "
