Bayfield development deferred again

VARNA — A proposed subdivision in Bayfield at
Lidderdale and Troy Streets has been sent back to the
drawing board after a packed meeting at council
Monday night with residents showing their objections
to the development.
The development by Durand Construction Inc was
originally proposed at a meeting last July.
The proposal put forward Monday night by Durand
was for 81 dwellings, down for an original number of
87.
Speaking for developer Joe Durand, Ian Sheddon
said the proposal was for a retirement community of
81 and has been reconfigured with no town houses
facing the homes to the north.
Sheddon said 116 letters have been received with
five in support.
Of the 106 opposed, 79 were what he described as
form letters stating their fear the community will lose
its image as a retirement image if the development
goes ahead.
The density of the development was a primary con-
cern for residents with the smallest of the proposed
lots 557 square metres, below the Bayfield zoning
bylaw requirement of 900 square metres.
Potential traffic and drainage problems were also
raised by those in attendance.
Asked by deputy mayor Paul Klopp if the planning
department had allowed variances for smaller lots
than the 900 square metre requirement, Huron
County planner Sandra Weber said not for entire
developments.
Asked by coun. Bill MacDougall if he would be happy
with a deferral in order to rework the development,
Durand said he couldn't understand the reason for a
deferral and would like to move ahead.
Comments from the gallery registered disapproval of
the plan, ranging from descriptions of the develop-
ment as a "trailer park," to "the developer will decide
the future of Bayfield," "for profit doesn't meet the
needs of Bayfield," and "I don't want to live on a free-
way."
Bayfield coun. Dave Johnston noted the objections of
those in attendance saying "the vast majority think the
official plan should be obeyed...it's quite clear a large
portion don't want the official plan and zoning bylaw
changed."
A recorded vote on a motion to defer the develop-
ment until it meets the Bayfield zoning bylaw and offi-
cial plan was defeated.
A second recorded motion to defer the proposal to
allow Durand to bring back a new plan was passed.
In other business, in response to a letter from
Bayfield resident Bill Rowat about late night noise in
Bayfield, Shawn Johnston and Tim Tatchell of the OPP
and Bluewater bylaw enforcement officer (BLEO)
Lorna VanderPloeg appeared before council to discuss
the situation.
Johnston said last summer there were 11 complaints
in Bayfield about late night noise from bar patrons

and in response the OPP concentrated forces in down-
town Bayfield around closing time.
He said a number of tickets were given out for liquor
violations but the OPP was not enforcing municipal
bylaws.
VanderPloeg said noise complaints have been diffi-
cult to enforce in other areas with several thrown out
due to a lack of witnesses and recommended the
municipality use a decibel reader to enforce noise
bylaws.
Coun. Johnston added with the closure of several
bars in other communities, `Bayfield has become the
place people go."
Asked by Coun. Johnston if the OPP can enforce laws
for causing a disturbance, Johnston said yes.
Johnston added he felt council has taken action with
the hiring of VanderPloeg and that "Rowat under-
stands council won't ignore it."
A motion was passed that Rowat be contacted and
informed of the steps council has taken.
