Meyers, cert° 116, Zurich. • • At the High Court non -jury assiz- es held at Goderich last v. eek the ac- tion of Ellerington vs. Quinton was ried before Mr. Justice Kelly of Toronto. The trial lasted a day and a half and was strongly contested on both sides. As the litigants are well known in- this community the case a- roused considerable interest. Fred.A. Ellerington, with his wife and sister- in-law, Miss Margaret E, Quinton, sued the estate of their uncle, the late Richard Quinton, of which they are Executors, for $9500, for care and keep during the Iast six years of his life. The only remaining, Execut- or, a nephew, Thos. Quinton, contest ed the claims- on behalf of the estate and counterclaimed against Mr. Ell- erington on a promissory note in favor of deceased which, with inter- est, now amounts to about $4600. A counterclaim ' was also entered a- gainst Miss Quinton to account for ,the proceeds of a Victory Bond of $1000,• held in trust for her uncle. The plaintiffs claimed that Richard Quinton had told .them they were to file claims against his' estate when he died and evidence was given that in his later years the deceased was troublesome. However, on cross-exa- mination it was brought out that in a previous examination they had not so reported the promise, nor had they ever asked Mr. Quinton for payment in his lifetime, although in need of money. He was described as a man of sturdy honesty who wo- uld not have left unpaid any claim which he considered he owed. IIis nieces admitted that they had each received a deed of a hundred acre farm valued then at $6000. from their uncle some years ago, and lat- er a Victory Bond while Miss Quin- ton also received $60.0. Mr, and ?dra Ellerington and family of five had ived in the home of deceased ,since, 1919 free of rent, taxes or repairs anti had received liberal advance's - Ir. J 0.
