The non -jury action John Hartman, of Seaforth, sued Edward Denomme and his wife, Martine Denerunte, Hay Township, for $6,065.52 and interest on a mortgage. The judgment dis- missed the plaintiff's claim without costs, except for the 1933 taxes, and allows the defendant's counter-cIaim for specific performance of the sale and purchase agreement, directing delivery of a deed of the lands in question from the defendants to the plaintiff, upon payment of $600 by the plaintiff, less the amount of 1933 taxes. Costs to defendants. Fifteen days' stay. Two divorce cases we- re adjourned to the next court. The jury at the assizes, in progress re- turned a verdict for $1,000 damages in favor of Isreal Olanow, Jewish pedlar, Toronto, against the Goderich Manufacturing:Co., and J. E. Beath - ler, its president and manager, for malicious prosecution and false ar- rest The plaintiff sued for $30,000'. The verdict came as a distinct sur- prise, in • view of Justice Hope's charge; to the jury, in which he stres- sed that Baechler, the defenclanthad only done what any business man and good citizen would do under sim- ilar circumstances—he had consulted his lawyer and, in turn, the police magistrate and crown attorney, and laid the facts before them, before causing a warrant to be issued. How ever, the jury required less than half an hous to give an affirmative answer to the cinestient! "Was the prosecution malicious?"
