Beer In Huron and Perth
Now Legal
Following the ruling by Judgi
Grout of Brampton that the Canada
Temperance Act is ultra vires in On-
tario, Premier Hepburn Wednesday
last issued instructions that the Liqu-
or Control Act now be enforced in
i Peet, Perth and Huron counties and
on Manitoulin Island. Last year the
Supreme Court of Canada, on an
appeal brought before it by the Ont.
Temperance Association, ruled that
•±e Canada Temperance Act was snore
restrictive than the Liquor Control
Att. This was taken by the appella-
nts to mean that the former statute
should take predence over the Ontar-
io; law. When this was announced,
the government took the stand that
the Canada Temperance Act was not
on its books and that it had no right
to enforce it. Since the L.C.A. was't
asnsidered to be in force, there Watt
one contusion in the counties. All
eer and wine authorities were held
p pending an appeal. "The supreme
ourt didn't pass on the eonstitoti-
nality of the enactment; Judge
rout has," Premier Hepburn said.
His ruling bears out what what has
een our stand right along, that the
.TA. is ultra, vires. Our law elerks
old us that. Authorities which were,
sued in the commies affected before
ie supreme court decision will notcencelted,
cancelled, at least not for that
.ason," •
