An application for the inquiry under Section 7 of the Combines Act was made in January 4976 by Mr. L.P. Edmonston, Presid- ent of the Automobile Protection Association, and by five other Canadian citizens. The inquiry was concerned with the appli- cant's allegations that the Ford Motor Company published ad- . vertisements in various Canadian newspapers in December 1975 promoting rust -fighting measures on Ford 1976 model automo- biles which contained statements that were "deceptive and mis- leading" within the meaning of the Act. Thus, the inquiry dealt with issues quite separate and dis- tinct from the private class- action suit concerning rust problems with Ford cars of earlier model years, which has received some publicity and which does not raise any issue under the Combines Act. In April the Minister was quoted in the press as saying that the Ford Company was `being investi- gated" under the Combines Act. Because of, the possibility that the different issues are linked' in the minds of. consumers the r Minister said it was only fair to - the Ford Motor Company that s he should make clear to the public f that the two matters are quite r distinct. t The investigation has produced no evidence on the basis of which it could be shown that the advertisements in question were in violation of the misleading advertising and deceptive pract- ices provisions of the Combines Act, The Ford Motor Company was extremely cooperative in the course of the inquiry, in provid- ing not only a substantial volume of technical information to sub- s an ate the claims made in the advertising, but also in providing access to its plant so that officers of the Bureau could observe the application of the rust -fighting measures. The Minister said he was satisfied that on the basis of extensive investigation, the Ford Motor Company had been com- pletely exonerated of misleading advertising in so far as their advertising promoting the sale of 1976 models was concerned, and he had decided not to in- struct the Director, aahe has the power to do under the Act, to make further inquiry.
