Bayfield legal
battle over
After ten years of investigat-
ion, research and litigation the
„Battle of the River Flats"
in Bayfield, Ontario, has finally
been resolved out of court, acc-
ording to Reeve Ed Oddleifson.
Blue Anchor investments
Ltd. has acquired, by purchase,
the possessory rights of Donny
McLeod:George Peter and Nancy
Castle, which comprises most
of the area which has been in
contention.
The ownership of the area of
the marina has not, as yet, been
completely clarified. The public
right of an access to the River
will be protected by the acquis-
ition, in perpetuity of a 25 foot
right-of-way along the northerly
boundary of the Federal property.
The fishermen are also prot-
ected by the addition of 10'
along this boundary for their
fishing reels.
The 25' right-of-way leads
from the original bridge app-
roach to the old public launch-
ing ramp, at the west end of the
federal government property
and will remain, as mentioned
above, a public thoroughfare in
perpetuity.
There is some doubt as to .the
usefulness of this ramp to the
general public. However, the
village docs have some • trans-
ient storage space at the entrance
to the flats. it is anticipated that
this space could be made avail-
able during the active boating
season.
The council of the village,
which entered into this controv-
ersy nearly 10 years ago, feels
that it has carried out requests
from the fishermen and the
Ratepayers Association of the
village to protect their rights in
as reasonable planner as was
possible.
The three encumbants, who
had possessory rights, have
relinquished them to Blue An-
chor Investments Ltd, in a mann-
er apparently satisfactory to each
owner. On the other hand publ-
ic access to the River has been
protected even though parking
space may not be as plentiful
as could be desired. -
Although this is not a solut-
ion the village had hoped for,
public access has been preserv-
ed, according to Bayfield reeve
Ed Oddleifson.
