Five object to zoning bylaw
Five official objections to the
Zurich Zoning By-laws were
presented to the council at their
meeting on Wednesday after-
noon. when Huron County plann-
er Gary Davidson was present
to review the documents.
The first objection was from
Doug Armstrong and Don Russ-
ell, and covered three separate
points. They disagreed with the
M2 zoning on their property
and suggested it should be a
•'D" for developmental zone.
Their second point was simply
pointing out that there was an
oversight in the printing of the
by-law in section 1:4, where
the industrial classification of
M 1 and M2 had been omitted
in error. Third point raised by
the two omen had to do with non-
conforming uses and the poss-
ibility of hardship.
Mr. Davidson suggested that
no action be taken on the first
part of their objection, but that
the objecturs should be notif-
ied that an application for a
plan amendment would be cons-
idered based on a specific use
and with the ,appropriate backup
material to support such a re-
quest.
Regarding the error in the
printing of the by-law, Mr. Dav-
idson said this error should be
noted and corrected.
"The third section of their
objection regarding hardship
is slightly different," Mr. Dav-
idson explained, "and to over-
come this potential situation I
would suggest an amendment
to the Official Plan allowing
zoning to existing use where
hardship can be shown by rem-
aining as a non -conforming use."
The second objection, that of
Mrs. Elda Wagner, contained
two points. Firstly, Mrs. Wagner
pointed out that 'Frederick St.
N. is shown on the zoning by-law
as ending at Mary Street, and
not extending north to the vill-
age limits.
Mr. Davidson noted that tech-
nically this was not an objection to
the by-law itself; but he added
that the village could open the
road if it wished. He added,
however, that this would only
serve one lot which is presently
owned by Harold Stade, and in
consultation with Mr. Stade
he was told he (Stade) did not
object. "No direct recommend-
ation can be made on this point
since roads are not zoned,"
he concluded.
Mrs. Wagner's major object-
ion concerned her residence
located at the corner of Mill
and Victoria Streets. The resid-
ence at one time contained a
store which was open until 1 %6.
Mr. Davidson pointed out that
the residence was in an area
defined as residential but near
the home there is commercial
property as well. He suggested
that if the home were to be
used for commercial purposes
again any council would prob-
ably look favourably upon an
application for re-classification,
but added that he felt the zoning
on the property should not be
altered at the present time.

to the north part of his property
along highway 84. Mr. Davidson
explained that this particular
objection was not concerned with
the by-law itself, but added that
the sub -division to the north
does provide access to the rear
of five lots and could not be
designed in such a way so as to
provide direct- access to Mr.
O'Brien 's lot or the lot immed-
iately to the west.

that nothing could be done in
this case, and the Municipal
Board should be asked to res-
olve the platter if it feels that
it is a matter of zoning.
' Both Mr. and Mrs. Percy
Bedard Jr., and Len Debus,
filed an objection similar to that
of Mr. O'Brien- regarding access
to their property, but Mr. David-
son pointed out that in these
two cases legally registered
right-of-ways arc in question.
The planner went on to explain
that after prolonged discussions
with the Ministry of Housing
the draft plan for a subdivision
in the area has been amended to
re-establish a road in front of
the Bedard home, and in view of
this he suggested that both the
Bedards and Mr. Debus could bc
asked to withdraw their object-
ions.
The final objections to the
zoning by-law from the Ontario
Ministry of Housing, and 'two of
their points were regarding
simple typographical errors.
Their third point noted a change
in penalties for violations of
the by-law.
Following the thorough expl-
anation by the county planner,
council passed a resolution out-
lining it's action on each obj-
ection, which will go forward to
the Ontario Municipal Board
along with alt other pertinent
information. The submission
to the board will also include a
request to procet-d ‘+'ith a hearing

for the Village of Zurich, Mr.
Davidson explained that the by-
law actually came into effect •
on January 22, 1975, when it was
'first passed. He also pointed
out, however, that the by-law

On Wednesday, January 7,
Zurich suffered a 6-3 defeat at
the hands of the Mitchell crew.
Scoring for Mitchell were Jay
Heinbuch and Rob Stoveli with
two goals each. Jackie Chaffe
and Ralph Staffen added singles.
For Zurich Robert Willett
led the attack scoring twice
with Jim Willett and Brian Horn-
er each picking up an assist.
Kris Bedard added a third tally,
Zurich Pee wees travelled to
Bayfield Friday, January 9
and came up with an 8-2 win.
Leading Zurich in the scoring
was Kris Bedard with five goals
and two assists, followed. by
Robert Willett with two goals
and an assist. Jim Willett picked
up a single and Brian Horner
assisted twice.
For Bayfield David Consitt
and Mike Telford each scored
one.
On Silver Stick action at
Watford, Zurich Pee wees won
their second game in the tourna-
ment defeating Thedford 8-1
on Saturday.
Scoring for Zurich was Kris
Bedard with six goals and one
assist, Robert Willett chipped in
with two goals and three assists.
Mark Kirk and David Smith each
picked up one assist.
Scoring the lone goal for
Thedford was Guy Wilde.

for Zurich is Friday, January
