MOTEL
2.49 Means one building, or two or more
connecting buildings, or two or more
detached buildings for the purpose of
catering to the needs of the public trav-
elling by privately owned motor vehicle
by furnishing sleeping accommodation
with or without supplying food and shall
include a motor hotel, auto court, and
all such buildings.
NON - CONFORMING
2,50 Means a use, building or structure which
does not comply with the provisions of
this by-law for the zones in which such
use, building or structure is located as of
the passing of this by-law.
OBNOXIOUS USE
2.51 Means an offensive trade within the mean-
ing of Public Health Act or any use which
is offensive or dangerous by reason of the
emission of odour, smoke, dust, noise,
gas fumes, liquid, vibration or refuse
matter.
OFF - STREET LOADING SPACE
2,52 Shall mean a space on which a truck
may be parked for standing, loading, or
unloading services. Such space shall
have adequate menas of ingress and egr-
ess to and from a public street or lane to
and from a public street or lane, and
shall be so arranged so as to avoid undue
interference with public use of streets and
lanes.
OFF - STREET PARKING SPACE
2.53 Shall mean a space to the rear of the
building line or lines, on which a vehicle
may be parked, having an adequate
means of ingress and egress to and from a
public street or lane.
PARKING LOT
2.54 Means any area other than streets or lanes
used for the temporary parking or storage
of motor vehicles in the open air.
PUBLIC GARAGE
2.55 Means a building where the principal
sctivity is the repair, service or storage
of motor vehicles.
ROOM HOUSE
2.56 Means a dwelling in which the proprietor
supplies room but not board, for monet-
ary gain to more than three persons excl-
usive of lessee or owner thereof or mem-
bers of his family and not open to the
general public.
SIGN
2.57 Shall mean a display board, screen cloth
or structure, having characters, letters,
or illustrations, applied thereto or displ-
ayed thereon in any manner, including
signs within a building visible from the
street, and shall include the posting or
painting of an advertisement or a notice
on a building or structure.
STOREY
2.58 Means the portion of a building other
than a basement or cellar, between the
surface of any floor and the surface of the
floor above it, or if there is no floor above
it, that portion between the surface or
such floor and the ceiling above it.
STREET OR ROAD
2.59 Means a public or common highway aff-
ording principal means of access to abutt-
ing properties.
STREET LINE
2.60 Means the limit of the street or road
allowance and is the dividing line bet-
ween a lot and a street.
STRUCTURE
2.61 Means anything that is built or construct-
ed or parts joined together.
USE
2.62 Means the purpose for which a lot or
building or a structure of any combinat-
ion thereof is designed, arranged, occup-
ied or maintained.
YARD
2.63 Means any open, uncovered, unoccupied
space adjacent to a building, and in det-
ermining yard requirements the minimum
horizontal measurement shall be used,
and
1) front yard means a yard extending
across the full width of the lot between
the front lot line and the nearest part
of any building or structure on the lot,
or the nearest open storage use on the
lot.
2) rear yard means a yard extending across
the full width of the lot between the
rear lot line and the nearest part of any
building or structure on the lot or the
nearest open storage use on the lot.
3) side yard means a yard extending from
the front yard to the rear yard between
the side lot line and the nearest part of
any building or structure on the lot or
the nearest open storage use on the lot.
Part 3. General Provisions
GENERAL
3.1 The provisions of the Section apply to all
Zones as they are applicable.
ACCESS
3.2 All buildings shall have access to a public
street.
BUILDING LINES
3.3 1) Unless other wise specified in this By-
law, the building line shall be a min-
imum distance of twenty-five (25')
feet from the existing street line or
public right-of-way.
2) Notwithstanding the preceeding sub-
section above, on any lot between two
existing buildings which are between
the street line and the building line
established by this section, a building
may be erected, the front wall of which
is in line with the front wall of the ex-
isting building closest to the required
building line.
3) On any lot between the existing build-
ings, both of which are farther from the
street line than the building line establ-
ished by this section, the line of the
front wall of the building closest to the
street line shall be deemed to be the
building line. In the case of a corner
lot, adjacent to a building farther from
the street line than required, the line
of the front wall of the adjacent build-
ing shall be deemed to be the street
line.
CORNER LOTS
3.4 On a corner lot, side yard requirements
may be substituted for rear yard require -
mens.
CORNER LOTS SIGHT LINES
3.5 On a corner lot no obstruction higher
than three (3) feet shall be permitted
closer than twenty-five (25) feet from
the street corner formed by lot lines, or
the straight line projection of lot lines
where such lot lines are connected by a
curved line.
FRONTAGE
3.6 Where a building has access to a public
path, that path shall be deemed to be the
front of the lot.
GARAGES, ACCESSORY BUILDINGS
3.7 Detached private garages and/or other
accessory buildings shall not:
1) be used for human habitation
2) be built in front yard. Where an acc-
essory building is built on a corner lot,
it shall be located in the side yard
which is not adjacent to the flanking
street, or in the rear yard.
3) Exceed fourteen (14') in height, nor
contain more than one storey.
4) exceed ten per cent (107/o) coverage of
the total lot ,area.
5) be built closer than four feet (4°) to a
side lot line if constructed in a side
yard, nor closer than two feet (2') to
a side or rear lot line if in a rear yard,
except that common semi-detahced
garages may be centred on the mutual
side lot line.
6) be built within six feet (6°) of the main
building.
7) be considered an accessory building if
attached to the main building in any
way.
HEIGHT LIMITATIONS
3.8 No building or structure in any zone other
than R1 and R2 shall be permitted to exc-
eed forty-five (45) feet in height. In Rl
and R2 zones no building or structure
shall be permitted to exceed thirty (30)
feet in height. This provision shall not
apply to limit the height of chimneys,
church spires, water tanks, elevator
enclosures, flag poles, television or radio
antennae, ventilators or skylights.
LIGHTS AND SIGNS
3.9 No persons shall erect a sign or outside
lighting fixtures in any zone, except in
conformity with the following regulations
applying to all zones:
1) Illuminated signs of the flashing or
animated type are prohibited, except
in C, and M Zones.
2) Lights and signs shall not be erected
in such a way as to be confused with
traffic lights or signals, or be otherwise
hazardous to traffic.
3) Lights used to illuminate a sign, build-
ing or premises, including a parking
area, shall be so arranged to deflect
light away from the adjacent premises
or streets.
4) No sign shall be erected between the
building line and the street line.
5) In connection with a parking lot, one
(1) accessory sign, not rnore than twelve
(12) square feet in area, may be erect-
ed at each point of entry or exit.
6) In Commercial and Industrial Zones,
one (1) accessory sign may be erected
for each place of business and on each
frontage. Such sign:
a) shall not project above the roof level
of the building or structure to which
it is necessary.
b) shall be located above the canopy or
show window, and shall be located
above the canopy or show window,
and
c) shall be attached to, and parallel
with, the wall of the building or
structure to which it is accessory
throughout the entire length of the
sign.
7) In the C5 (Service Station Commercial)
in addition to the other sign provisions
of this section, there may be erected
one sign on a standard or pylon -free
standing -in an island to the rear of the
building line, projecting not more than
4 feet above the roof or parapet.
