THE CORPORATION OF THE
VILLAGE OF ZURICH
By -Law No. 1974
BEING A BY-LAW TO REGULATE THE USE OF
LAND AND THE CHARACTER, LOCATION AND
USE OF BUILDING AND STRUCTURES PURSUANT
TO SECTION 35 OF THE PLANNING ACT, R.S.O.
1970.
NOW, THEREFORE, THE COUNCIL OF THE CORP-
ORATION OF THE VILLAGE OF ZURICH ENACTS
AS FOLLOWS:
Part 1. Administration
TITLE
1.1 This By-law may be cited as the Zoning
By-law.
DEVELOPMENT
1.2 Schedule A, attached contains the dev-
elopment standards which apply to the
permitted uses described in the text of this
By-law.
APPLICATION
1.3 This By-law applies to those lands shown
on Schedule B, and covers all lands with-
in the corporate limits of the Village of
Zurich.
ZONES
1.4
For the purposes of this By-law the follow-
ing Zones are established. The lands incl-
uded in various Zones are shown on
Schedule B. This by-law establishes
certain zones in which no land is placed.
The purpose here is to allow for certain
types of uses in future which are not pres-
ently found in the Village.

BOUNDARIES
1.5 Where on the Zoning Map a boundary is
shown:
1) as following a street, lane, or right -of
way the centre line of the street, lane
or right -of way, is the boundary;
2) as following lot lines on the registered
plan of subdivision the lot lines are the
boundary;
3) as running substantially parallel to a
street line and the distance from the
street line is not indicated, the bound-
ary is parallel to the street line and
the distance therefrom shall be as deter-
mined according to the scale shown on.

4) as following a natural feature, such as a
river, the natural feature, at the time
of the required interpretation, is the
boundary.
COMPLIANCE WITH THE BY-LAW
1.6 1) The purpose for which any land or
building is used shall not be changed,
no new building or addition to any
existing building shall be erected, and
no land be severed from an existing
building lot, if the effect of such
changes, erection or severance is to
create a situation in which any of the
requirements of the By-law in access-
ory building or building lot, is Contra-
vened.
2) The provisions and regulations of this
By-law shall be held to be the minimum
requirements except where the word
maximum is used in which case the
maximum requirements will apply.
3) In case any building or structure is
erected altered, reconstructed, extended
or enlarged or any building or structure
or part thereof is used, or any land is
used,, in contravention of any require-
ments of this By-law, such contravent-
ion may be restrained by action at the
instance of any ratepayer or of the
Corporation, pursuant of the provisions
of the -Municipal Act in that behalf.
4) Every person who contravenes any
provision of this By-law is guilty of a
recurring offence and is liable upon
summary conviction to a penalty not
exceeding $300.00 per day exclusive
of costs.
5) If any provision of this By-law, includ-
ing anything shown on the Zoning Map
(attached as Schedule B) is for any
reason held to be invalid, it is hereby
declared to be the intention that all
the remaining provisions of the By-law
shall remain in full force and effect
until repealed, notwithstanding that
one or more provisions shall have been
declared to be invalid.
ZONING ADMINISTRATION AND PERMITS
1.7 1) This By-law shall be administered by
a person designated from time to time
by the Council as the Zoning Adminis-
trator.
2) After giving forty-eight (48) hours
written notice the Zoning Administrat-
or is hereby authorized after appropr-
iate notice to enter at all reasonable
hours for purposes of inspection upon
any property or premises.
3) In addition to all the requirements of
a Building By-law or any other By-law,
every application for a building permit
shall be accompanied by not less than
two copies of drawings and site plans
(one copy to be retained by the Build -
Inspector) drawn to a suitable scale.
The application or site plan as approp-
riate, will provide the following.
a) true dimensions of the lot to be
built up or otherwise used.
b) the proposed location, height and
dimensions of any buildings, structure
or use proposed for such lot.
c) all dimensions relative to yards,
drives, an offstreet parking facilities;
d) the location of all existing buildings
or structures on the lot shown on the
plan.
e) existing contours of the land and
proposed contours, if any site change
is anticipated.
t) information concerning landscaping,
curbing, drainage, retaining walls,
and any other physical addition to the
site.
g) a statement, signed by the owner
of the property, disclosing the exact
use proposed for each aforesaid build-
ing, structure or use, and giving all
information necessary to determine if
such building, structure or use conforms
to the requirements of this By-law.
4) Notwithstanding any other By-law, no
building permit or other municipal
permit, shall be issued for any build-
ing or structure which does not comply
with this by-law.

Part 2. Definitions
For the purpose of this By-law the following words
and phrases shall have the meanings given below:
ACCESSORY USE _
2.1 Means a use customarily incidental and
subordinate to the principle use or build-
ing and located on the same lot with such
principle use or building.
AMENITY AREA
2.2 Means the area situated within the bound-
aries of a multiple dwelling project and
intended for recreational purposes, which
may include landscaped site area, patios,
balconies, communal lounges, swimming
pools and similar uses, but shall not incl-
ude the area occupied at grade by the
buildings, service areas, parking and
driveways.
AUTOMOBILE SERVICE STATION
OR SERVICE STATION
2.3 Means a building where gasoline or oil
is kept for sale and where only minor
emergency repairs essential to the actual
operation of motor vehicles may also be
performed, and where grease, anti -freeze
tires, spark plugs and other automobile
accessories may be sold incidentally, and
where motor vehicles may also be oiled,
greased, or washed, but where no other
activities of a public garage are carried
on.
BASEMENT
2.4 Means that portion of a building between
two floor levels which is partly under-
ground but which has at least one half of
its height from finished floor to finished
ceiling above adjacent finished grade,
as approved.
BUILDING
2.5 Means any edifice used or intended to be
used for shelter, accommodation or encl-
osure of persons, animals or chattels other
than a lawful boundary wall or fence.
BUILDING ACCESSORY
2.6 Means a subordinate detached building
or structure not used for human habitation
designed or intended for the better or more
convenient enjoyment of the main build-
ing is oris intended to be erected and
shall include a private garage.
BUILDING INSPECTOR
2.7 Means the officer or employee of the
Corporation for the time being charged
with the duty of enforcing the Building
By-law of the Corporation.
BUILDING LINE
2.8 Means a line within a lot drawn parallel to
the lot line which separates the lot from
any public right-of-way and establishes the
minimum distance between that lot line
and any building or structure, which may
be erected.
BUILDING MAIN
2.9 Means a building in which the principle
use is conducted on building lot on which
it is located. In the residential zone the
dwelling is the math building.
CELLAR
2.10 Means that portion of a building between
two floor levels which is partly or wholly
underground but which has more than one-
half of its height from finished floor to
finished ceiling below adjacent finished
grade, as approved.
CORPORATION
2.11 Means the Corporation of the Village of
Zurich.
