A By -Lay to provide for drainage work
in the Village of Zurich, Township of Hay,
'County of Huron, and for providing the
sum of three hundred and fifty-six dollars
and ten cents, the amount required for
•completing the same.
Provisionally adopted the first day of
August, 1904.
Finally passed the day of
A. D. 1904.
Whereas the majority in number of the
resident and non-resident owners, (exclus-
ive of farmer's sons, not actual owners,) as
shown by the last revised Assessment roll
-of the property set forth to he benefitted
by the said drainage work, have petitioned
the Council of the said Township of Hay,
praying for drainage of certain lands in-
cluded in Vauthier's Survey, Village of
Zurich, park lots Si 21, S. W. part 21,
and village lots 1 to 9 inclusive, Knell's
survey; village lots 9 to 16 inclusive, also
village lots 65 to 70 inclusive, and mill re-
serve block in the same survey. Brown's
'survey, lots 1 to 4 inclusive, and mill re-
serve in the same survey all in the village
of Zurich.
And, whereas thereupon the said council
has procured an examination to be made
by F. W. Farncomb, being a person com-
petent for such purpose, of the said area
proposed to be drained and the means
suggested for the drainage thereof, and
other lands and roads liable to assessment
under the "Municipal Drainage Act,' 'and
has also procured plans, specifications and
estimates of the drainage work to be made,
by the said F. W. Farncomb,and an assess-
ment to be made by him of the lands and
roads to be benefitted by such drainage
work, and other lands and roads liable for
contribution thereto, stating as nearly as
he can the proportion of benefit, outlet
liability and injuring liability; which in
bis opinion will be derived or incurred in
consequence of such drainage work by
every road and lot or portion of lot, the
said assessment so made being the assess-
ment hereinafter by this By -Law enacted
to be assessed and levied upon the roads
and lots or parts of lots hereinafter in that
behalf specially set forth and described
and the report of the said F• W. Farncomb
in respect thereof and of the said drainage
works being as follows: -

sary surveys, levels, estimates, specifica-
tions and assessments, with plan and pro-
file in order to ascertain and show the

extent of the repairs and improvements
required to present drain along the north
side of Main Street in the Village of Zurich
(being part of the Road Allowance between
lots 20 and 21 in the 12th and 13th Con-
cessions of the Township of Hay) persuarit
to the petitions signed by F. Hess and
others.
I recommend the work hereafter speci-
fied and further set forth in the plan and
profile acid which has been measured and
marked upon the ground and assessed
therefore the lands and roads according to
schedule of assessment herewith, under
their respective headings for various pur-
poses mentioned in the Statute as shown
in my schedule of assessment and accord-
ing to the circumstances applicable to each
parcel of land assessed.
DESCRIPTION OF THE WORK.
The proposed work will consist of a new
tile drain on the north side of Main St.
replacing present box drain which has
become decayed and stopped up, from a
point distant one chain and seventy links
easterly from the easterly limit of Fred-
erick Street and the covering of present
open ditch, a total distance of 13 chains
and the deepening and widening of the
remainder of the open ditch to the Munici-
pal Drain known as the Zurich Drain
South, all as shown on the accompanying
plan and profile.
The tile to be best quality thoroughly
seasoned concrete (or field) tile to be ap-
proved properly laid and bedded and cover-
ed to depths and.grades shown and to the
entire satisfaction of the Engineer or Com-
missioner in charge of the work. Junc-
tions or Y's properly }lugged to be placed
at intervals where required and as direct-
ed by the Engineer or Commissioner
throughout. All crossings,culverts, walks,
etc., or otherwise (as well as the road bed)
necessarily removed or affected in the per-
formance of the work to be replaced or
repaired to former position and usefulness
by the contractor. The whole of the work
to be done in the best possible manner and
to the satisfaction of the Engineer in
charge of the work.
The portion of open ditch to be made
two feet -wide in bottom sides slopened one
to one and the earth placed at least three
feet clear of edges on either side as may be
directed.
I estimate the cost of the work as fol-
lows. -Concrete cement tile to lengths and
dimensions shown, $171.60: Excavating,
laying and covering and repairs to open
ditch, $125.40; Survey and report, $30.00;
Preparing and publishing by-law, Clerk's
fees,. letting superintending. etc., and
other expenses incidental to the work,
$29.10; Total, $356.10.

And, whereas the said Council are of
the opinion that the drainage of the area
'described is desirable.
Therefore the said municipal Council of
the said Township of Hay, pursuant to the
provisions of the "Municipal Drainage
Act" enacts as follows: -
1st. That said report, plans, specifi-
cations, assessments and estimates are
hereby adopted, and the drainage work as
therein indicated and set forth shall be
made and constructed in accordance there-
with.
2nd. For paying the sum of $88,00,
the amount charged against the said lands
for benefit, and the sum of $173.10, the
amount charged against the said lands for
outlet liability, apart from roads belonging
to or controlled by the Municipality, the
following special *Ate., overland above all
other rates, shall be assessed, levied and
collected in the same manner and at the
same time as other rates are levied and
collected upon and from the undermen-
tioned lots and parts of lots and roads and
and the amount of the total special rates
against each lot or part of lot respectively
shall be seseeied, levied and collected as
aforesaid in any one year after the final
peeling of this By -Law.

municipality, shall, over and above all
other rates, be levied and collected in the
salve manner and at the same time as other
rates are levied and collected upon and
from the whole ratable property in the
said Township of Hay, in any one year,
after the final passing of this By -Law.
4th. This By -Law shall be published
in the Zurich HISRALD in accordance with
Sec. 21 of the "Municipal Drainage Act.'

NOTICE Is HEREBY GIVEN that a Court of
Revision will be held in the 'Down Hall,
Zurich, on Monday, the 5th day of Sept-
ember, 1904, at the hour of 2 o'clock in
the afternoon for the purpose of hearing
and trying complaints and appeals against
the above assessment or any part thereof
and the ratable proportionate assessment
for future maintainance of said dram and
in the manner provided by the Assessment
and Municipal Act and amendments there-
to, and all notices of appeal shall be served
upon the Clerk of Hay, at leash 10 days
prior to such Court of Revision.
AND FURTIIER NOTICE is hereby given
that any person intending to apply to have
the above By -Law or any part thereof
quashed must not later than 10 days after
the final passing thereof serve a notice in
writing upon the Reeve or other head
officer. and upon the Clerk of said Town-
ship of Hay, of his intention to make ap-
plication for that purpose to the High
Court of Justice at Toronto during the six
weeks next ensuing the final passing of
the said By -Law. .

COUNTY NEWS.
The engine •house of Thompson's
saw mill in Bayfield was destroyed
by fire before it was noticed.
A very unfortunate accident be-
fell James Walker, of :Clinton, last
Thursday morning while at work
in Cooper's lumber yard. He was
passing a. pile of lumber when it
fells ser ox him, brealkipg the. bones
of his. left leg below the knee, and
otherwise injuring him.
There are 107 county bridges in
Huron, the different branches of
the Maitland river being responsible
for most of them. Many of these
bridges are built of wood. and are
rapidly playing out. In the next
few years the county will be at a
large expense in replacing these
bridges with iron structures.
A sad drowning accident oceured
last Saturday afternoon at Bayfield.
whereby Geo. Osborne lost his life.
He was attending a picnic and went
in for a swim, and is supposed to
have taken cramps, as he sank and
drowned before help arrived. His
home was in Clinton, and he was
spending his holidays there with
his mother, who is a widow.
Frank Schuller met with a bad
accident at N. Clull & Sons planing
mill, Seaforth, Thursday morning.
While at work he had the misfor-
tune to have his hand caught in a
rapidly revolving circular saw. One
of the middle fingers was out comp`,
pletely off, and several others bad-
ly cut. Mr. Schuller will be laid
up for about two months.
The ten -year-old son of Mr. W. J,
Verity, of Brantford, who is visit-
ing his grandmother, Mrs. Pickard,
at Exeter, mot with an accident
the other day which will materially
go to mar his vacation. While at
his uncle's, Mr. T. B, Carling's, he
climbed a tree in front of the resi-
dence and while lowering himself
by aid of a limb, his' hand slipped
and he fell to the ground, a dis-
tance of several feet, and alighting
on the left arm it was broken in
two places at the wrist. The little
fellow is doing nicely.
Registrar Coats was made the
recipient of an exceedingly hand-
some present and address the other
evening at Clinton, The address
is signed by one hundred and forty-
seven citizens of Clinton, is most
handsomely engrossed and illumi-
nated on parchment by J. Ades
Fowler, and is bound in morocco.
The address was accompanied by a
beautiful grandfather'sclock, with
case of mahogany and brass trim-
mings. Tho presentation took place
after the council meeting, Dr. Shaw
doing the honors of the occasion
and making the presentation with
his informal "Here, Billy, this is
yours." 8
The temperance people in Clinton
are working up the local option
movement in that town. A petition
signed by 266 municipal electors
was presented to the council at
their last meeting and asking that
a local option bylaw be submitted
to the vote of the people at the
municipal elections in January.
The petition was granted.
A terrible accident happened Iast
Friday at Walker and Clegg's new
upholstering factory at Wingham.
Michael Robertson, aged about 56,
had charge of the installing of the
new engine. It had almost been.
completed and the fly wheel was
about to be lowered into position,
when the stays supporting it slipp-
ed and the shaft fell upon Mr.
Robertson. He was drawn forward
on to some bolts ready to bolt it
securely. These bolts penetrated
the man's lungs, while the weight
of the wheel crushed his life out.
Medical aid was speedily at hand but
to no avail. The deceased leaves a,
widow and several children.
The contracts for the construc-
tion of the Guelph and Goderich
Railway were signed on Tuesday,
as a result of the negotiations on.
Monday afternoon and evening M.
A. Piggott of Hamilton was given
the contract for No. 2 and No. 3
sections. These were the only ones
remaining undecided. Monday. The
construction of the entire line there-
fore, is in the hands of two con-
tractors. D. B. Campbell of Strath-
roy has the contract for sections
Nos. 1, 4, 5 and 6, and Mr. Piggott
has sections No. 2, 3, 7 and 8. The
work will commence at once, and
it is expected that the line will be
opened by October, 1905.

Ann Buswell, beloved , wife of

27th, Isabella May, second daugh-
ter of Mr. and Mrs. Duncan Mo -
Ewen, at the age of 25 years and
5 months.
