Toronto, Sept. • 11.—Mr. Justice
Raney at Osgoode Hall yesterday,
granted the appeal of Allan Rainton,
Frank Bainton and Arvada Bainton
from the order of Assistant Master
G. A. Drew allowing the corporation
of the village of Blyth to foreclose
the woolen industry of the defend-
ants.
The facts of the case as presented
to his lordship are that the plaintiff
corporation in 1928 passed a by-law
which granted a bonus to the woolen
industry of the defendants. In order
to secure the repayment of the sum
a mortgage was taken out on the pro-
perty, the first installment of which
became dud on March 20, 1929. 13y
an order of Assistant Master Drew,'
foreclosure proceedings were allowed
to be instituted.
R. T. Ferguson, now of Toronto,
formerly of Morris, for the defendants
woolen industry and taking a mort
acted outside its jurisdiction. He al -
gage do the property to secure same,
acted 'outisde its jurisdiction. He al-
so asserted that the council of the
corporation had agreed to extend the
time for the payment of the first in-
stalment on the mortgage, and had.
then instituted the foreclosure pro-
ceedings,
A']:r. Justice Raney found that the
agreement as to the extension of the
time had been the result of a "loose
understanding."
W. Proedfoot, on behalf of the
plaintiff, contended that the village
had acted within its jurisdiction and
that his lordship should give judg-
ment on the merits of the case.
His lordship refused to try the case,
but granted the appeal, requiring
counsel for the defendants to give
satisfactory guarantee that the assets
of the industry would not be dissipat-
ed in the meantime.
