Monday after- noon by Mr,. Justice. Rose in a Su preme Court action for $1,000, aris- ing out of a fire in September, 1927, which the plaintiff, William George McNeil, claims 'was set by the;de- fendant, Herbert ' Laughran. The parties are neighbor farmers in the Township of 'Wallace. The fire damaged several shade 'trees and land owned by Mr. McNeil, Lough- ran admitted the fire was set in his lush , by his hired man, Alvin Coul- ter, when they were cleaning up the swamp. Seven witnesses appeared forthe plaintiff, while six defense wit- nesses gave evidence. D. G. Camp- bell, of :Listowel, appeared for the plaintiff; while W. E. Goodwin, Strat- ford, and H.
