of Management without appealing to
the voters, The board consists of

David Laidlaw, E. Bender and J. D.
Moody;
3. The debeetures as to both prin-
cipal and interest shall be- expressed
in Canadian Currency and may be

4. The Debentures and the interest
coupons shall be signed and issued by
the 1Mayor and shall be. ,signed also
by the Treasurer, and the debentures
shall be sealed with the seal of the
Coropoeation.
5, During the currency of the De-
bentures there shall be raised annual-
ly Seven hundred and forty-nine and
�121zo0 dollars to form a sinking fund
for the payment of the debt and sev-
en hundred and fifty dollars for the
payment of ,the interest thereon, ma-
king in all Fourteen'hundred and ni-
nety-nine and :12100 dollars to be
raised annually for the payment of
the debt and interest.
6. The Debentures may contain
any provision for the registration of
them authorized by law.
7. This By-law shall take effect on
the day of the passing thereof sub-
ject to its being assented to by the
electors.

TELLING WHEN . MAN IS
DRUNK
In Canadian courts for. some time
.past there has been 'a tendency to
give a man arrested bn a drunk
charge the benefit of the' doubt. Ma-
gistrates deal with such cases with
extreme caution. In this day of mot-
or traffid we doubt if this should be
done. The risk of the public de-
mands that they should be given the
benefit of the doubt. Anyone will
agree that it is better to punish a
dozen drunken car drivers, even if it
is doubtful whether _ they were
more than half drunk or quarter
drunk than to let one of them -injure
er kill - a pedestrian, In the English
courts they have adopted ,a,.test which
is accepted as conclusive evidence..
They give a; man who is arrested as
a drunk a football bladder to inflate
with his breath. .•If two litres of
breath is found to contain I,5 milli-
grams of alcohol the man is 5o per
cent. drunk. If the man is 5o per
cent. or more drunk by this test be,
is convicted. /

For borrowing the sum of.
Fifteen thousanddollars for
the • purpose of granting a
loan of that amount to Ery
& Blackhall Limited.
WHEREAS Fry & Blackhall Lim-
ited has applied' to The Corporation
of the Town of Wingham for a loan.
of ,$15,000.00 to assist them in pur-
chasing new premises and enlarging
the output from their business of man-
ufacturers of upholstered and other
furniture' carried on at the said Town
of Wingham and have agreed to re-
pay the principal' of the said loan in
fifteen equal consecutive annual in-
stalments and to pay interest on the
unpaid principal yearly in the mean-
time at 3 per cent. per annum and
that the said loan shall be secured
by a first mortgage on the lands and
premises so to be purchased by them:
and on all the plant and machinery of
the Company situate therein and to
be situate therein during the currency
of the said mortgage;
AND WHEREAS IT IS DEEM-
ED EXPEDIENT to grant the said
loam;
AND WHEREAS in order thereto
it will be •necessary to issue deben-
tures of the said Corporation for the
sum of $15,000.00. and that is the a-
mount of the debt intended to be
created, the proceeds of the said de-
bentures to be applied to the purpose
aforesaid and
a to no other,.
AND WHEREAS the amount of.
the whole rateable property of the
Municipality according to the last re-
vised assessment roll is $1,129,045,
AND WHEREAS the amount of
the 'debenture debt of the Corpora-
tion is $322,965.23 and no part of the
principal or interest• of which is in
arrear.
BE IT THEREFORE :ENACTED
by the Municipal Council of the Cor-
poration of the Town of Winghamr-
r.. For the purpose mentioned in
the preamble there shall be b9rrowed
on the credit of the Corporation the
sura of $15,000.0o and debentures shall
be issued therefor or: the sinking fund
plan in stuns of not less than $loo.o0
each which shall have coupons attach-
ed thereto for the payment of interest.
2, The Debentures shall all hear
the same date and shall be issued
within two years after the elate on
which this By-law is passed, and may
bear` any date within such two years
and shall be payable within fifteen
years from the date when they shall
be issued, and shall bear ''interest at
the fim:ate of five per cent. per annual,.
