Pte Cook Writes
The two following lettere will prove
interesting to our readers as to show
the work the Red Cross is doing and
the noble way our boys take their
wound..
New End Hospital Apr ISth.
Dear Mother: -
1 guess you will think 1 have for.
gotten to write, altogether it ie nearly
three weeks now since I wrote last but
things have been moving so fast over
here that we hardly get time to write
I suppose you will hays heard about
the big drive the Canadians has made
long before you get this letter it was a
glorious old drive and uuo that won't be
forgotten for a long . time We started
shortly after five Monday morning and
wee still going ahead on Saturday
when I got bit with a piece of Martinet
in the foot and had to come bank.
I am in England in the Hospital but
don't expect to bo here very long.ae it
is only u little scratch, more of a bruise
than any thing. 1 didn't expect to get
back here at all I only thought that I
would get a few days rest but you know
I was always a lucky guy any way
there wasn't any of the other Seaforth
boys hurt, that I know of.
I did not get the mail before leaving
France but it will be there when 1. get
back 1 think the parcels and the money
yon Gent arrived just after we went
in the trenches, the last time 1 told
any two chums to share the parcels be-
tween them when 11eft, that was a
bargain we had between the three of
us if one'got hurt the other two was to
get the particle, we always shared up
with one and another any -way.
Well mother I am not saying any
thing about the fight because you wil
know all about it in the papers but 'I
don't want you to worry any, because
my foot is not very sore and I expect,
to bo book in France by •the time you
get this letter. The people here in the
hospitals aura treat no great they don't
seem to be able to do enough for us,
Now mother dear when you write
just put the old address on, will write
again in a day or two love to Dad so
bye bye.
From youriovinK son

Celebrated Case
Robert F Jones, T M Grieve Fred Rob
Inson and Samuel Diekson Vs The
Township of Tuekersmith and
R Kruse
On the t3th of Jan 1913 the Council
of Tuciceramith passed a by-law closing
Mill Street north of Queen cutting off
access to plaintiffs' lots and depriving
them of the use of the street. Then
the Township ed'ld the street to the
defendant Krnoe who placed a building
across it. Mr Jones cud the others in-
terested tools proceedings to set
aside the bylaw, and the deed and
to compel Kruse to remove his building
off the street. The order was made by
Justice Middleton, The Township ap•
pealed and the 2nd division of the Apel -
late Court set aside this order and dir-
eoted the motion and action on the
conveyance to be tried together. The
trial took place in Stratford before Mr
Justice Latchford, who found in favor
of the plaintiffs, quashed the by-law
set aside the CouTeyaace and directed
Kruse to remove his building, with
costs, The Township appealed and
the let Appellate Court set aside that
part of Justice Latolsford's judgment
which quashed the whole by-law but
held it was not legal for the Township
to Bell the street. Plaiutift's appealed
to the Supreme Court and Kruse 'arose,
appealed in so far as his title was oon-
cerned. On the 211d inet a unauimone
judgment was given for plaintiff's which
motored the judgment of Justice Latch
ford, dismissed Kruse a appeal, the de
feninnts being ordered to pay all costs
This judgment is a vindication of pia•
intifis' ooutentiou, It took them a
longtime and incurred rielc of paying
emits, . 1n thee fighting a wealthy cor-
poration they showed much plunk. The
ease has settled the law tor Ontario as
to the powora of municipalities to oloeo
streets laid down on plane which, had
never been adopted as public highways
