Hall on Thursday evening of this week. LEGAL. -At the Court of Appeal on Tuesday the case of Nightingale, vs. Western Assurance Co. was heard. Mo• earthy, Q. 0., and W. M. Douglas for the defendants, appealed from the re- port of the County Judge of Horon upon a reference to him to acertain the amount of lose by fire of the plaintiff upon a stook of goods in a shop in the Town of Brae - eels insured by the defendants. The ref• res found that the plaintiff's loos was a. bout $4,000. The appeal was against the finding of the referee that there was no fraud or false swearing in the proofs of loss. W. R. Meredith, Q. C., end Gar - row, Q. C., for the plaintiff, opposed the appeal and supported a croee•appeal from the report.
