S. MacKenzie last week ruled in favor of eight land owners who asked that posses- sion be blocked until De. 31, by which time the Ontario Supreme Court divisional ; court should have ruled on its legality. A Wellington County judge handed down a similar decision 10 days earlier. Ontario Hydro was to have taken possession Aug. 2 of strips of land on 214 properties along the 51 mile route of the line. The line is to run from near the Bruce nuclear power plant at Douglas Point to a village near Orange- ville. It will pass through four coun- ties and a group of 40 land owners is opposing it through the county courts and the divisional court. The farmers argued that if hydro is allowed to begin con- struction as planned, they will suffer damage and their case be- fore the divisional court will be prejudiced. The appeal will be more difficult, they said, if major sections of the line are built by the time it gets to court. Hydro officials claimed a' delay would cost the province millions of dollars. The first Bruce station will eventually have four re- actors, project engineer Alex Collins said, while existing lines out of the site can accommodate The Wingharn Advance -Times, August 24, 1977 the power from only two and a half reactors. This would leave power "bottled up" at the station which it would cost the province several million dollars a month to replace. Mr. Collins later admitted that even if Hydro were on the land immediately the line would not be finished until March, 1979, while the existing lines will be at capa- city a year earlier. Hydro lawyer R. A. Ayre also accUSed the land owners of using delaying tactgcs,,, saying the appeal to the divisional court could have been made earlier, allowing it to be heard before December. He said the expro- priation should not be delayed be- cause the farmers are not suffer- ing -'real personal loss", such as eviction from their homes. The judge said his decision is not Rased on what he feels; the divisional court may do, but as long as there is a .possibility the expropriation may be overturned the land owners should be sup - ported. Hydro officials have said they will appeal the decision.
