Zoning arnen rejected by Morris But railway land proposal not totally dead with deferral By JIM BROWN He noted that perhaps there The Advance -Times should be a committee established After much discussion, Morris Township council didn't approve a zoning amendment application for Lot 31 of Concession 1 at its regu- lar meeting last Tuesday. Howev- er, it also didn't totally reject the proposal. The owner of the property want- ed to have the land — an aban- doned CN railway line — re- zoned so he develop the property as five lots. The property in ques- tion is about a 1/2 kilometre soutth of the hamlet of Bluevale on the Centre Sideroad. Council was told that if they did approve the zoning amendment, the Ontario Ministry of Agricul- ture, Food and Rural Affairs (OMAFRA) would appeal the de- cision. While the Village of Blyth had no objections to the zoning amendment, the Huron County Health Unit and the County plan- ning department did have con- cerns. Before any zoning amendment would be considered test holes to five feet in depth would have to be drilled on each of the proposed lots, and a drainage plan would have to be submitted. Craig Metzger of the planning department said that the zoning amendment does not conform to the secondary plan. "Non -agriculture use is not per- mitted on prime agricultural prop- erty," he said. "And, this is prime agriculture land." Metzger added that there is very little latitude for the township. He said that under provincial guide- lines, rural non-farm development should be discouraged. "This does not conform to the secondary plan, and we (the plan- ning department) recommend that the amendment not be passed," he said. Chief building officer Paul Jo - sling said the property was never economically viable for agricultu- ral purposes. Metzger pointed out that while all former railway lands have nev- er officially designated, they usu- ally are classified the same as the adjacent property. "The government has taken away a rufall municipaity's flexibil- ity when tit comes to Class 1,2, and 3 lands,' he said. "Three- quarters of Morris Township is Class 1,2, and 3." Kevin Pletch said if the county planning department is against the amendment and OMA - FRA will appeal if council ap- proves the application, there is not much that council can do.
