In the event the decision is reserved, persons taking part in the
hearing and wishing a copy of the decision may request a copy from
the presiding Board member or, in writing, from the Board. Such,
decision will be mailed to you when available. •

EXPLANATORY NOTE
The Township, of Turnberry passed a Comprehensive Zoning By-
law (By-law 14-1987) on October 6, 1987. The zoning by-law affects
all lands in the Township of Turnberry by regulating the use of lands
and the character, location, and use of buildings and structures in
• various defined areas of the Township. The zoning by-law imple-
ments the Township. of Turnberry Secondary Plan and provides
specific land use Zones and provisions to ensure that the policies of
the Secondary Plan atelealiod.
The followirig objeCtiiis 'received by the Board:
1. CN Rail - has four conceiris, as follows;
a. minimum 15 metre setback of dwellings from existing
• railway right-of-way;
requirement that seller advisepotential purchasers of
CN Rail's existing right-of-way, rightlo-expand, po-
tentialrioise and vibration, and that not responsible
for complaints or claims;
c, a drainage reportbe required for proPosals whichalter
the existing drairragi3 pattenion CN Ownedlands; 00
d. a chain link fence 01 1.83 metre height be erected by
property owners along Mutual property line. •
This objection is outstanding.
In addition to the appeal above, the following appeals were also
received by the Township. The Township of TuMberry will be asking
the Ontario Municipal Board, at the commencement of its hearing,
that these appeals also be considered;
2. Mr, S. J. Trapp - to have By-law'amended for Lot 26 Conc.
12, by changing from Agriculture (AGI) to Recreation the zo-
ning to permit a private recreational and camping park; objec-
tion outstanding.
3. Mr. George Darlint - to verify that the Restricted Agriculture
(AG2) zoning does not prohibit the use of the existing barn to
its existing capacity; and that the reconstruction of the barn
on its current bcation and to its existing capacity petmitted,
resolved by resolution #98/88; objection was Withdrawn. ----
4. Mrs. Alice Baker,. Edgar John Ranger et al - to rezone prop-
erties in Lower -lawn from Developmental to Commercial or'
Industrial to recognize...the existing industrisloperations in the
vacinity; addressed by status Zoning in By-law 19;4988, and
