As protection against trespass, the 'proposed legislation would raise the fine for trespassing from $100 to $1,000 and would permit the courts to impose on convicted trespassers the costs of prosecutions. It would also allow the courts to compensate landowners for damage caused by trespassers, to property or crops. The .proposed legislation would add orchards•and fields under cultivation to the category of land to which g Y entry , is prohibited without the landowner having to post signs or. give other notice. Under the present law, only lawns, gardens and en- closed lands are included in this category. The proposals also call for limiting the liability of owners to persons who enter their land to a duty to take reasonable care to ensure their safety. This duty would not beowed to persons entering land for criminal purposes. Also proposed is a code of colored markings and signs which would allow owners to designate which activities they wished to permit on their land. Under the system an owner could, for example, permit cross- country skiing but prohibit all other ac- tivities on his land. Alternatively, he could specify a limited number of activities -he-wished to prohibit,,., thereby in- dicating permission for all other activities. The Attorney General is distributing the White. Paper to all interested groups and individuals and have requested their comments by the end of June. Copies of the White Paper are also available from the office of the Attorney General, Queen's Park, Toronto.
