Darcy said he got the idea from a book of suggestions in his art class and used two 30 -minute •art sessions, to -. complete the project. Malone Petroleums Ltd. get proper zoning for its property before it rebuilds its gas bar building destroyed by fire in June of 1978. The building, a frame. structure just large enough to house a cash register for the gas station and counter space for selling soft drinks, chocolate bars and cigarettes, was destroyed by fire but the gas pumps and storage tanks were undamaged. Malone Petroleums pressed a house trailer into service to re -open the business after the fire and has been seeking a building permit to Construct a new hut. Harold Lamb, part owner of the gas station, told council Monday night that the permit the firm sought was not to re -build the structure but to re- model. He said the fire disrupted business but as soon as a structure was available to work out of the business began selling gas again. In a letter to council town solicitor Dan Murphy saidcouncil should seek appropriate zoning amendments for the property before a building permit is issued. He said the gas bar was a legal non -conforming use having been established before the town adopted its official plan. Murphy pointed out to council that the property in question has housed a service station or similar business since the 1940's when William J. Mills located a car dealership there. Since that time a number of owners used the lot for similar businesses until 1972 when a building permit was issued to Malone to construct a gas bar. At that time the town was in the process of establishing the official plan and was issuing building permits on the individual merit off each application. Malone's permit was issued and when the official plan passed the property used for the gas bar was zoned industrial which does not permit a gas bar. Malone became a legal non- conforming use at that time. The fire which destroyed the gas bar became controversial when claims were made that members of the Goderich police depar- tment cancelled the fire call made when the Malone fire was reported. Lamb claims that a constable thought the fire call concerned the Burger Bar rather thap the gas bar and that the officer checked the area out finding no fire. The constable suggested smoke always came out of the kitchen of the Burger Bar and cancelled the alarm. Later a second call was turned in and this time the fire trucks arrived at the gas bar. Lamb claims the fire started very slowly and if there hadn't been a mix- up there would have been no fire. Councillor Stan Profit suggested that council had a moral obligation to Lamb. He told council the matter was. one "One of those from the heart things that Profit gets Into", He pointed out to council that the business had not ceased to operate and that council "should be interested in getting young, energetic businessmen to this area rather than scaring them to another community".
