OWNED A & P
SITE
By the same method as
here detailed, Miller became
owner of Lot 19 on West
street, part of the site oc-
cupied in later years by the A
& P store and still occupied
by the brick residence which
originally was Carl's barrel
factory.
It is resonable to suppose
that Ben Miller, being a
builder, built Dan's hotel, and
may have lived there. His
deed was dated May 25, 1848,
and there would not be any
building much in advance of
the title. Ben paid the Canada
Company 136 pounds for 50
acres, comprising Lot 1, Con.
1, Colborne, E.D. Ben was
described as "of the township
of Colborne, yeoman." The
price paid the Canada
Company was far more than
charged for farm lots;
evidently the Company put
special value upon potential
waterpower.
At this point, Ben became
what we would now call a
developer. He began at once
to sell small lots. (See map).
First purchasers were James
Stacey, William and Thomas
Logan, woolen mill operators
before the Gledhill brothers
built theirs in 1877, and
Stanley Meiklejohn, Scotch
blacksmith.
Probably these people were
already on the ground as
squatters; Miller, too, but he
could not sell lots without his
deed.
There is strangely little on
record about his gristmill,
first built beside the river and
afterward moved up to Main
street. When it was at the
riverside, there was a
sawmill between it and Main
St. as would be expected in
view of the building
operations, operated by
Gledhills.
Ben's son Archibald is
described in one document,
after his father's death, as
"miller," but he could not
have continued long in that
capacity before the mill
"passed into stronger hands,
David Rodges, M. Pfrim-
mer." The quote is from John
Elliott, who was a boy at
Benmiller when his father
(this writer's grandfather)
worked for Rodges at the
mill.
MILL HISTORY
The Huron Gazetteer of
1863 lists David Rodges as a
miller in Colborne, but it was
1866 before Dan Miller con-
veyed the property. It passed
in 1873 to Michael Pfrimmer,
who evidently did not operate
it continuously through the
years, for in 1881, according
to the Signal, "W.G. Luker,
proprietor of the Benmiller
flouring mill, left on the 20th
for Victoria, B.C."
In the next year, "William
Piper, of the Harbor Mills,
Goderich, leased the Ben -
miller flouring mill. It is
going to receive a general
repairing."
Anyway, Pfrimmer's son
Ernest took over in 1910. He
sold out ,to his sons Russell
and Elwyn, who operated the
mill until it closed. Con-
version into a roller mill took
place in 1890, and in wartime,
with electrical power, it
turned out a great deal of
flour.
Ben Miller bequeathed to
his brother Dan "Lot 2 in the
village of Colborne Mills." He
appointed as executors "my
esteemed neighbors Elijah
Martin and Thomas Gledhill"
and later added Joseph
Gooding of Goderich. Wit-
nesses to the will were Arthur
Molesworth, teacher; Robert
Carflpbell of Kinloss, and
Nesse Gledhill, Benmiller.
He left to his brother
Joseph "my interest in the
lease of that parcel of land
which I hold on lease from the
County, commonly known as
Joseph Miller's farm and
situate in the western division
of Colborne."

disposed of by Joseph in his
will, made ten years before
his death in 1882.
"To Thomas and Sam

area I now occupy, part 'of
Falls Reserve, but not to
come into full possession until
they are 21, that they may
keep me in their memory. To

remainder of my real estate,
as a token of my thankfulness
to him and his wife for the
care and kindness ex-
perienced since coming to
live with them."
Joseph named as sole
executor "Sam Hart the
younger."
Date of Daniel Miller's
death has not been deter-
mined. He is listed in a
gazetteer of 1863 as in-
nkeeper, at which time
Jonathan would have been 19.
It is riot known just when
Jonathan took over, but
according to the Huron Signal
of Sept. 18, 1877, he had
erected a large addition to his
hotel.
"Part of the new
building," it was stated, "has
been fitted up for a grocery
store and post office. Last
summer 'Mr. Miller increased
his stable accommodation, so
that in every particular the
Benmiller hotel is indeed a
first-class stopping place."
SPRING WATER
TALE
The Registry Office records
that on Sept. 7, 1880, John
Breen conveyed to Jonathan
Miller certain water
• privileges. The story behind
that routine item is that Dan
had a tenant to north of the
hotel, on whose land was a
stream of spring water.
One evening Dan got him
"a little tight" and he signed
over the water privileges.
Thereafter, the hotel,
previously supplied only from
a well and pump in front, was
provided with cool running
water.
Jonathan Miller after
leaving Benmiller conducted
Hotel Bedford in Goderich
from 1896 when it was built
after the Albion fire, until
1904. In 1901 he was dickering
for a suitable automobile: The
Signal reported that he "was
in Detroit a few days this
week looking over the
machine that will soon be
finished and sent here for the
well known proprietor of the
Bedford".
. Also in the 1900s, he
operated the Grip House in
Seaforth. That site is now
occupied by Topnotch Feeds
head office building on south
Main street. For some time
he conducted a livery stable
on East Street, Goderich, but
the Motor Age had doomed
that business and Jonathan
moved to Carlow, where he
died in 1910 at 61. •
"Jonathan in youth was
somewhat slender," the
Signal stated in its obituary
article, "and was known as
an active young man. At
maturity his chest
measurement was 84 inches,

Date of tale photo is uncertain, but it shows the Benmiller hotel and stables,
the grist fill, "Ben Miller's bridge" and a house on the street next to the
river.
The Huron Signal announced in September, 1877, that
Jonathan Miller had built a large addition to his hotel at
Benmiller, part of which was to be used as a general store
and post office. Here it is shown three years later, complete

appear to have 20 panes .. Jonathan, who took over the hotel
from his father, Daniel, would be 32 years of age at the time
this photo was made.

What is the effect of an
assignment in bankruptcy?
A trustee in bankruptcy
(usually a chartered ac-
countant) is •appointed. He
then takes possession of the
property of the bankrupt and
prepares an inventory. He
may then sell or dispose of the
property of the bankrupt and
use the proceeds to reimburse
the creditors.
Certain property of the
bankrupt is exempt from
seizure. This includes some
personal property such as
clothing and the like,
I think 1 may have a bad
credit rating. How can I find
out?
The Ontario Consumer
Reporting Act, passed in 1973
provides that every consumer
may enquire of a reporting
agency whether or not a file is
maintained concerning his
credit standing. The con-
sumer's request must be in
writing, and the information
must be supplied without

The Consumer Protection
Act states that where a buyer
under an executory contract
has paid two-thirds or more of
the purchase price of the
goods as fixed by the contract
and if the buyer then defaults
in payment then the seller
niay not retake possession of
or resell the goods without a
court order.
When the seller demands to

refuse him entry. It is your
property and his refusal to
leave amounts to trespass.
Remember, however, that
you are still required to pay
the balance owing.
