The old principle of freedom of•testation" (the right to do,.
whatever you want in your :will) ,s -:slowly crumbling under the
need for, legislation to enforce .worthwhile-sorialpolicy: It has
1png,been recognized that a person should not be•"able to .die .
and leave inadequate provision in his or her will for the spouse
and children. --• • '
In Ontario, the.Dependent's Relief Act. says a man or woman••
must leave his dependents (spouse and children) a.dequete prove,;_ }.
sign in the will or elss the court will do -it for hem. There are many
factors• take's, into account,••:in. determining "adequacy" of
provisions. „
A lawyer can-ezplain them to you and help you apply. to court
for relief.' The cburt in your case will very likely take away much
of th •`gift to the Society and give it,to you .and the children. •.•
Note,however, that you will'not receive more thanyou-would
have received had" your husband died without a will, •
