Eighteen years ago when my wife and I got married we owned
piece of property jointly. Three years later we sold this
propertyand bought another oneon which stood a general store;
Our plans at that time were for me to keep on working, and for
her,(my wife) to run the store, but our lawyers suggested that
we should put this property in my wife's narrie•alone, so this is
what we did.
We have now separated but she has gone ahead and rented out
this store with herself as sole lessor which means that she is
receiving ALL of therent each month which .I don't think is
right, since l;helpedto pay for the place originally.
i've spoken to..a lawyer about this but he says there is nothing
that 1 can do, I'm hoping he may be wrong so t'd like to get. your
opinion on this situatiorf.
Unfortunately' the law does not look at it your way. .Because
you caused the property to be transferred into the name of your
wife alone a "presumption of advancement" arose, This means
'.the law presumes you gave her the property as a gift. Unless you
can show a court of law that the circumstances were such as to
rebut this -presumption, you are out of luck.

•
To get the old age "security", as Ottawa .now labels it, you.
don't have to be -a citizeQ to receive it, -but you must have resided ..
in Ca -nada for a 'Minimum period cif 10.years. The fact that• you
are unable to locate your birth certificate is not as serious as it
may appear. Proof Of.age is what the government has to• have,
and there are a large number of civil servants whose job•itis to
do just that. ..tre births.
All .that you have to -do is to .complete and mail an official
application form available from any post office, and tell thein
the reason why. you are` unable to produce a birth or baptismal
certificate. Our trusty civil servants will do the rest. .
