The by-law proposes to amend the "Non -Conforming Uses" provision (section 6.4.) of By-law , 38-1985 to award legal status to non -complying uses, buildings, or structures which were legally established prior to By-law 38-1985 being passed: Also, a clarification is proposed to be added to Section 6.4. to explain that in the case of non-compliance with yard re- quirements, the enlargement or extension of non -complying buildings may occur provid- ed that the change does not cause the building to be located closer to the lot line than the existing building. The by-law also proposes to include the Restricted Core Area Commercial (C5) zone as being eligible to provide cash in lieu of not providing the required parking. ANY PERSON may attend the public meeting and/or make written or verbal representa- tion either in support of or in opposition to the proposed zoning by-law. ADDITIONAL INFORMATION relating to the proposed zoning by-law is available for inspec- tion between 8:30 a.m. and 4:30"p.m. at the municipal Office. N7A 2K5 (519) 524-8344 SCHEDULE 1 CORPORATION OF THE TOWN OF GODERICH BY-LAW -1986 WHEREAS the Municipal Council of the Corporation of the TOWN OF GODERICH considers it advisable to amend ZONING BY-LAW 38-1985 of the Corporation of the TOWN OF GODERICH; . _. :. ........_. .... .... NOW, THEREFORE the Council of the Corporation of the TOWN OF GODERICH ENACTS as follows: 1. Section 6.4. of By-law 38-1985 is' hereby amended and replaced with the following: 6.4. NON -COMPLYING USES Where a use, building or structure was legally established prior to the date of the passing of this By-law, and is permitted by the provisions of the zone in which such use, building or structure is located, but does not meet the zone provisions with respect to yards, lot area, frontage, parking, setback or any Other provisions of this By-law applicable to that zone, the said building or structure shall be deemed to comply with the by-law and may be enlarged, extended, reconstructed, repaired or renovated provided that: 6.4.1. The enlargement, extension, reconstruction, repair or renovation does not further reduce the compliance of that use, building, or structure with the provisions of the by-law to which it does not comply. 6.4.2. In the case of non-compliance with yard requirements, enlargement, extension, repair, or renovation will be allowed along the entire length or width of the non -complying yard, as the case may be, provided that the building or structure is not located closer to the lot line than the existing depth of the non-cmplying yard which the existing building or structure has established. 6.4.3. All other applicable provisions of the By-law are complied with. 2. Section 6.13.4.1. of By-law 38-1985 is hereby amended and replaced with the following: 6.13.4.1. CORE AREA The provisions of subsections 6.13. shall apply to uses located within the Core Area Com- mercial (C4) zone and the Residential Core Area Commercial (C5) zone. In cases, however, where the required parking cannot be provided In the C4 and C5 zone, the council may accept an equivalent cash -in -lieu amount, which amount shall be allotted to a parking fund to provide necessary parking spaces as required: 3. SCHEDULE 2 BYLAW -1986 CORPORATION OF THE TOWN OF GODERICH Horse pulls and antique tractors pulls made up the majority of the entertainment at the Family Fun Day in Dungami'on on Sunday. (photo by Susan Hundertmark) Dungannon's Family Fun Day lived up to its name last Sunday The Dungannon Agricultural Society's Family Fun Day turned out to be just that - a day full of fun for the whole family! On Sunday, August 10, the events started at 1 p.m. with the horse pulls. Winners in the light horse class were: first Bob McLaughlin, Kippen; second, Clete Dalton, Amberley; third, Ivan Thomas, Paisley and fourth, -Carl Bale, Lucknow. Heavy horse winners were: first, Gary Kerr, Nile; second, Lorne Birk, Paisley; third, Don Sowerby, Goderich and Eric Drennan, Nile and fourth, Gary Kerr, Nile. The antique tractor pull was overwhelm- ing with 65 entries of tractors from 1958 or older. In the 3500 lb. class winners were: first, Larry Rier, RR 3 Arthur; second, Jim Pentland, RR 6 Goderich, third, Jim MacKenzie, Dungannon and -fourth, Barry MacDonald, Blyth. In the 4500 lb. class, Len Kerr, RR 3 Auburn came in first while second place went to Randy Pentland, RR 6 Goderich, third went to Adam Seip, RR 1 Stratford and John Knipe, Milverton placed fourth. There were 16 entries in the 5500 lb. class with.. winners: first, Ed Erb, RR 2 Wellesley, second; 'Casey Bayer; Ric r- Seaforth, third; Rob Robson, Dungannon and fourth, 'Cavil. Courtney, .RR ,1• 1. By4aw -1986 has the following purpose and effect: (a) By-law -1986 amends the "Non -conforming Uses" provision (Section 6.4.) of By- law 38-1985 to award legal status to non -complying uses, buildings, or structures which were legally established prior to By-law 38-1985 being passed. Legalizing such non- compliance Is ae'complished by the phrase "the said building or structure shall be deem- ed to comply with the by-law." Also, Section 6.4.2. Is added to clarify that a •non -complying building or structure may be - enlarged, extended, etc. along the width or length of the yard provided that the change does not cause the building to be located closer to the lot line than the existing building or structure. (b) By-law -1986 aniends the "Exceptions to Parking Space Requirements" provision for the core area (Section 6.13+4.1.) to Include the Restricted Core Area Commercial (C5) zone as being eligible to provide cash in lieu of not providing the required parking. ome .o Dungannon. In the 6500 lb. class, Kent Alton, RR 2 Auburn came in first, Ed Erb, RR 2, Wellesley placed second, George Smyth, RR 2, Auburn was third and fourth went to Don Kuik, RR 1 Dungannon. Wilfred Pentland won first in the 80001b. class, second place.went to Steve Howard, RR 7, Lucknow. David Turner, RR 1 Varna placed third and John Johnston, RR 2 Auburn won fourth. In the open class, Paul Black, RR 7, Lucknow won with his 11740 lb. John Deere from 1958 while Don Alton, RR 7, Lucknow, drove his 11400 Ib. John Deere to a second place finish. Paul Black's 8340 lb. John Deere from 1948 placed third. A special antique class was held for trac- tors from 1935 or older. Adam Seip from RR 1, Stratford won with his 1934 Allis Chalmers. Barry Smyth, RR 2, Auburn placed second with a 1929 McCormick Deering. Wilfred Pentland won third with his 1929 McCormick Deering. Tony Milten- burg, RR 7, Lucknow placed fourth with a Fordson tractor, built by Ries Miltenburg. It is a wood -burning tractor which was us- e . ill- Holland, during World_ War II when gasoline was not available. The West Huron Junior Farmers con- ducted sport activities for the children dur- ing the afternoon. Unfortunately, rain caused the variety program to be moved indoors. But, Brian, Elmslie from CKNX, was able to over- come any inconveniences caused by the change in plans. Included in the variety concert were: Tadpoles in a Jar, the Stapleton Sisters, Julie and Bill Thomp- son, Billy Tucker and his tribe, Larry Mac- Pherson accompanied by Ann Pritchard, Robert Ireland, Shauna Andrew, Betty - Lou Dalton and the Elmslie children. The 12 fair queen contestants in- troduced themselves. Last year's fair princess, Tanya Macln- nis, . crowned the ne princess, Laura Mulder, daughter o Fred and Alice Mulder, RR 1, Dung non. Mike McNee, son of-Lynd Mc , was chosen as the first Dungan air's Prince. The winner of the seven piece patio set was Dave Buffet, Guelph. The fun will continue at Dungannon's 127th Fair next weekend, August 15 and 16. Throughout the fair, a craft show and business display, homecrafts, flowers school and fair history exhibits can be viewed. Friday evening also offers a Kids' pet parade, judging of the 1986 Fair Queen. contestants,-: chainsawing, _.log sawing,, bale -throwing and arm -wrestling. Special entertainment will be provided by the t 2 -Col Trick Team, 2 young men using B.M.X. bikes in a stunt show that will thrill viewers. A 6 foot and a 3' foot ramp are used in the demonstration, which is cor- relted to music during the performance. On Saturday, the heavy horse show and the English and Western horse show both start at 10:30 a.m. with some of the finest horses in Ontario. Also; the fair queen contestants will be introduced and Denise Maize, Miss Dungannon Fair for 1985, will crown the new Fair Queen and first and se- cond runners-up. At 1 p.m. a Horseshoe competition will be held by the barn while 4-H Homemaking achievement awards are held inythe hall. Following, at 1:30 is the baby show with all babies receiving a gift.
