Richard Ottewell told the Alexandra Marine and General Hospital board at the May meeting Monday, he received letters from the Health Minister Murray ,Elston and the health ministry's deputy minister. The letters requested Ottewell hold a special board meeting to review steps to ensure the doctors will provide quality health care on Thursday and Friday of this week, when they withdraw all but emergency services to protest the ban on extra -billing. "I'm a little indignant that the minister would require me to monitor the conduct of the doctors at this hospital. That may be necessary at other hospitals in the pro- vince, but it is not required here. The ministry is requiring us to become a part of this dispute. I do not feel we need to become a part of a confrontation between one professional group and the govern- ment. "corrunented Ottewel'. Ottewell said he believes the board can rely on the fact that the quality of care will not suffer. He said if there is a more com- plete withdrawal of services and it becomes a problem with the functioning of the hospital or the quality of care, the management committee will meet to review the provisions of the hospital by- laws and if necessary call a special board meeting to make a decision. Count yourself in on Census Day June 3 BY PAUL HARTMAN June 3 is Census Day and Statistics Canada is encouraging you to "count yourself in". On that day, over 25 million residents from the smallest town to the largest city will be enumerated by over 38,000 census takers. In Huron County, some 200 people will be gathering detailed information about the county's people and their living conditions. Here in Goderich, approximately 22 cen- sus takers are each responsible for up to 400 dwellings. By now, you will have received your cen- sus form. Fill in the information requested on June 3 and then follow the instructions to return it to your local census representative. Since Goderich is a mail -in area, most residents can fill out their forms, tuck them in the envelope provided and mail them in on June 4. others, especially those in rural areas, will have their forms picked up. Either way, your census rep will be check- ing with you later to ensure that they have received all the necessary information and that it is recorded correctly. Cenus data have been collected every 10 years since 1871 and every 5 years since 1956. The information is used by all levels of government, businesses, associations and is - available to the public through local libraries. Especially relevant to this area is the agricultural aspect of the census. The Cen- sus of Agriculture is an enumeration of all farm operators in Canada with agpicultura1 sales of $250 or more in the previous 12 months. This information will be used to ensure ac- curate and well-informed decision-making for the future, whether at the individual farm level or for Canada as a whole. The census affects everyone. Judge reserves decision in Moody trial • from page 6 "Moody was operating under the law as advised by his lawyers and we have the ad- mission by Evans, who indicated the Oct. 22 letter Was abandoned almost as soon as it was sent out." If the law is otherwise, said Montello, Moody reasonably believed that a mistaken set of facts were true. "Evans is an official and he did convey to the fishermen that they could continue to fish until the appeal decision," said Montello. Even if it is the responsibility of the fishermen to remain within their quotas, Moody did everything possible to learn what his limits were, argued Montello. He sought the advice of his lawyer and the liason officer. "He relied on the ministry and the credibilty of two learned justices who agreed with the judgement he sought," stated Montello. Moody has indicated there was a sorts of confusion in the ministry office "The. ministry was going helter skelter i its at- tempt to control quotas," suggested Montello. • The ministry sought legislation within F this period from the federal government by statute quotas on Lake Erie fishermen and if the ministry's position were consis- tent, it should have sought the ,same legislation for Lake Huron as it sought for Lake Erie, he observed. When a ministry deals with fishermen, anglers and people it seeks to help, it's a minstry to serve the people. There should be a fairness attitude with all people, said Montello. "The ministry permitted Moody in ex- plicit terms to fish and then when the mat- ter was reversed in court, it stabbed Moody in the back by laying charges." observed Montello. EXPOITED DECISION In his summation, ministry prosecutor Mohammad Toor of Toronto said Moody tried to exploit the order made by Mr. Justice Smith and he does not agree there is any officially induced error. ' Toor said the ministry was not unfair. They upheld. the' law as they know it. He said that once Moody challenges a case in court, he must wait for the final out come of the case. "You uphold the law as it is while it is be- ing challenged. The law must be obeyed as it is proclaimed until such time as it is negated," said Toor. He is saying 'You have a licence. Go and fish." Evans did not know Moody was approaching the limit of his quota, un- til he received the October figures at the beginning Of November. "What you are saying is Moody is trap- ped. The court has said quotas are not ef- fective. The advice is we're appealing. We don't know what the outcome will be but you better observe it (quotas) in case we win. He's trapped for that whole fishing season." commented Judge Perkins. "The evidence before me and the reason he brought the acclamation to the supreme court is that he couldn't make a living. If he still must abide by the quota, he cannot make a livelihood."the judge added. Toor submitted that Moody was acting on the advice of his lawyer and therefore it was not an officially induced error. "Do'you expect me to ignore what Evans said in his testimony.." asked.
