While many revisions must be made to the town's draft zoning bylaw, council has asked its solicitor to help determine how to enforce the new bylaw. The motion to have town solicitor Dan Murphy present at the October 29 council meeting resulted from a discussion rele- vant to the enforcement of the town's zon- ing bylaw. Infractions are only acted upon if town officials receive a complaint councillor Bill Clifford argued suggesting that other infractions may go unreported. "I have heard the criticism that zoning is . only enforced if neighbours complain. The matter is brought to our attention and something is done," he explained. "We ride with the waves, which is not bad for a small town, but we must be consistent with zoning. Nobody is doing anything about in- fractions unless a neighbour reports." Town administrator Larry McCabe presented a report to council dealing with the enforcement of the town bylaw which was subsequently tabled until the next council meeting on Monday, October 29. In tabling the report , council also asked that the solicitor be present. McCabe explained that zoning bylaw 29 of 1972 has been enforced effectively in the past. When violations were brought to the attention of the administration, the infrac- tion was presented to council which ultimately made the final decision or rul- ing. The report indicated that the Huron County Planning Department suggests the bylaw should be enforced totally, separately and apart from council's in- volvement, and that all infractions are black and white and not prone to inter- pretation. The administrator pointed out that the Property Standards Bylaw, introduced in 1978, has been functioning adequately and is enforced mainly on a complaint -action basis. In a letter to the administrator on the zoning bylaw, planner malcolm McIntosh implies that enforcement should be the responsibility of an appointed person and that infractions should be acted upon. "As you are no doubt aware, I feel the enforcement of the new zoning bylaw should be the responsibility of an official appointed by +il uncil, and not enforced at the whim of '', uncil. I feel that in this method the residents of Goderich will be offered an equal and fair enforcement of the zoning bylaw," the letter read. A provision which permits administra- tion of the bylaw by the building inspector or a zoning administrator appointed by council it has lead to "patchwork enforce- ment of the bylaw and leads many residents to feel that council does not stand behind the bylaw,"McIntosh said: In his report, McCabe said complaints are received both verbally and in written form and investigated by himself ,the com- missioner of works or the building in- spector. If the concern violates a zoning bylaw then "we meet with the individual and try to resolve the situation." Most of the complaints deal with the home -occupation category and McCabe saidtnatinine Outten cases areresolvedby meeting with the individual and arriving at a solution that satisfied the objector. The administrator suggested, however, that many home occupations are grey under the bylaw but only extreme cases are brought before council, which then acts as the enforcement agency. If a mo- tion to enforce the bylaw results, the ad- ministrator generally meets with the in- dividual again. The administrator recommended that the new bylaw make provisions for a zon- ing administrator, appointed by council, and that eforcement of the bylaw be deter- mined by council.
