Following a two. week holiday period in ,.January,. Committee. hearings will.resume and continue until the Ontario 'Parliament re -opens. During the last week -of the session, 'Parliament sat from -10:00 A.M. to 10:30 P.M. in order to pass a number of items of legislation introduced by the government during -. the final days of this - session. Two companion pieces of legislation that the U.ntario Farm Com- munity have been seeking for—many years were among thenj. These were Bills 202; -'-ate Act respecting Occupiers' Liability and Bill .203, an Act to ' Protect against trespass to Property. Act 202 codifies the Comtnon Law as it ap- plies to the - duty of care that occupiers owe to people who come. on to their premises. This duty does not apply to people who willingly assume this risk when they enter agricultural lands, when __ ., _ . no. fee ►s p ltrratrd"whem the entry is ' for .. recreational purposes, Occupiers, of course,, could not create a danger — uith a deliberate intent. Ridings- • were con- cerned about the fad that the interests of children were -not mentioned and they had other questions about duty, of care, and so the members from Agricultural ridings agreed that the bill should be sent to Com- mittee during the next session to discuss these concerns.. Questions_ were raised about the con- stitutionality of the proposed Actand ':so, -•.it became apparent that the Act should not be rushed ..through and possibly later be rejected by the Supreme Court of Canada. In Bill 203, trespass on to• a garden, field or other land that is under cultivation, including a lawn, orchard, vineyard and enclosed land fenced to keep livestock off or on a property is prohibited without any notice. This is particular ly`otwiterest to people . whose lands were violated by people on recreational vehicles. It is also an answer to the problem of people who pilfer farm ,produce and ;who now face a fine of up to .,, $1,000.00 for Farmers have been very annoyed in the past when charges were laid, againstpeople for 'pilfering farm produce to find that magistrates almost always looked upon the charge as a joke. Farmers familiar. with- the law in -Florida, where the fine for trespass is $5,000.00 know that in some jurisdictions this is a serious matter. Both laws •affect not only agricultural land, and therefore, we • have agreed to send both Acts :.. to Committee where they will receive clause by clause examination. In. Committee, one of the issues that will ' be opposed by the • New Democratic Party is the fact that supermarket parking lots' can be declared off-limits ' for pi'Cketers or demon- strators. This is of vital importance in the matter -of secondary boycotts where picketers try to persuade shoppers not to blly certain products. Secondary boycotts are illegal in both the USA an&. Canada and we voiced opposition to any dilution of the Act that would encourage secondary boycotts. We, ,of course, support the right of workers to strike or withdraw their ser- vices except ,in cases of essential services but we db opposesettondary boycotts.
