"The Ontario government's May 20
budget gives, concrete backing to the in-
itiatives announced in the government's
Throne Speech," said David Logan, Presi-
dent of the Ontario March of Dienes. "Those
initiatives promised in the Throne- Speech
which address the special needs of adults
with physical disabilities, which now can
become reality,"
Corrunenting the day after the Budget was
brought down by Ontario 'Treasurer Bob
Nixon, Dr. Loganlsaid, "Such allocations as
the $11 billion to health and the $378 million
to housing should mean that promises are
kept to. expand the assistive devices pro-
gram, and to increase accessible housing
and attendant care."
"A particularly critical section of the
Budget is that directed at income. Ontario
March of Dimes is pleased to see the income
of $50 per month in GAINS -D benefits as
well as the tax relief offered to people with
low incomes.
, "In addition," said Logan, "The $290
milllion enrichment to. transportation
should see the fulfillment of the 'Throne
Speech promise of increased,. mobility for
disabled persons."
Logan predicted that disabled people,
their families, friends and allies will, in this
pre-election period, continue to press the

government for itemized couuriltnients,
with deadlines, in such priority areas as
assistive devices, attendant care, accessible
and equitable transportation and housing as
well as further income supports.
Programs listed in.the budget which will
affect disabled persons include:
- increased disability benefits.: A • $50 -0 -
month increase in benefits paid to disabled
people with low incomes begins Jane 30
under the (;AIMS -I) program.
- more low-income housing: $220 million
for low-cost rental units, plus $50 million an-
nually for operating costs. The government
promises to "enhance housing and in-
tegrated support services for the homeless,
the disabled, discharged psychiatric pa-
tients, victims of family violence, the frail
elderly...". Ministry of Housing funds are to
be increased by 34 per cent to a new total of
$378 million.
- tax relief for low incomes: The Property
Tax Credit will be increased from $180 to
$230. "As a result, an additional 100;000 peo-
ple .will pay no Ontario income tax and
60,000 will pay less Ontario income tax."
OHIP Premium Assistance will be expand-
ed by raising the income limits for premium
assistance. "As a result, another 40,00.0 in-
dividuals and families with law income will
no Ionger pay premiums." No -tax increases

The Law Reform Commission of 'Canada's
Working Paper. 55 entitled The Charge
,Document in Criminal Cases proposes a
variety' of recommendations to rid our pre-
sent rules governing the drafting' of criminal
charges of complexities and technicalities.
The Commission has attempted to balance
simplicity and clarity against the need to
maintain fairness in the administration of
justice. There has long existed a widespread
public perception that, , on occasion, '
criminals go free because of the success of.
technical objections based on some error
divorced from the. mertits • of the actual
charge. By contrast, a„ perception of un-
fairness also has existed because of what
many defence counsel describe as -a
"routine lack of factual information .in
criminal charges," especially in crimes
such as fraud or -conspiracy involving com-
plex factual. allegations.
The rules governing- the drafting of
criminal charges grew from the desire in
judges to alleviate the severity of the -law in
earlier times when a great many crimes
were punished by death by the gallows.
Thus the early case-law held that the
slightest defect in a criminal pleadingturn-
ed
un-
ed the whole matter -into a -nullity. Tfrge•
' has passed, but the courtshave had recur-
rent difficulty in shedding off the technical
restraints of the earlier case-law. Efforts •at
law reform' extending well over a 'hundred
years have been.similarly unsuccessful. The
goal -- the resolution of criminal trials on
their merits, not on the basis of technical
mistakes in the drafting of criminal charges
has been easy to, define but attaining it
has proven elusive.
Highlights -
The Commission recominends - that a
.. single document called a "charge docu-
ment" should be employed throughout the
process rather than the two forms which are
currently in use, that is. the "information"
and "indictment". Also, the- Commission -
recommends that the same rules of pleading
or drafting documents should apply to both .

has promised that "tax reform should not
preclude the introduction of a guaranteed

governing crimes should, to the• extent

Working Paper 55 also contains a variety
-of recommendation5'simplifying the form of
the charge document and clarifying the re-
quirements of -the contents of a. charge
document.
The. central proposal of the Commission's
paper results in the virtual eradication of
the so-called "doctrine of • nullity." Rather
than allowing charges to be quashed; the
Commission proposes,that broad powers of
amendment' be employed coupled with • a
court power to order other necessary relief
to an affected party such as the granting of
an adjournment, • etc'. 1 Only ,,j lllegations
which purport to charge a crime that is'
unknown to the law would result in total in-
validation under the Commission's propos-
ed scheme.)'
Another significant alteration to the ex-
i'sting „law urged by the Coinrnissi,on would
allow certain related charges to, be joined
with a charge of murder. ( Those crimes
which could be joined are manslaughter, at-
tempted murder, criminal negligence caus-
ing death, or any, other crime, capable of be-
ing tried before a jury which the accused
consents to have tried . with a charge of
Murder 1. Presently the Criminial Code does
not allow for these other charges to be join-
ed with one of murder.
The Commission also attempts in this
Working' Paper., to clarify- the law concerning
the ability of the court to ''grant a
severance" of accused or counts which are
joined together in a single charge document.
The Commission w•ould.give'a.discretion to
the courts to remove either named accused
or counts ina charge in specified cir-
cumstances. For example, where the accus-
' ed persons have antagonistic defences, a
severance might he Ordered, thus resulting
in separate trials.. Also, if important

Background
The•criminal charge is in essence.an ac.'-
cusation that an individual has committed a
crime, Charging a person with a crime' is. -
one of the most serious steps a society can
take against an individual and the mere fact
of being charged can have enormous r'eper-
cussions in the life of the person charged.
Because of 'the importance attached -to
this particular step in criminal proceedings,
a comprehensive webb' of technical re-
quirements has evolved over time to govern
and control its exercise. Primarily' these re-
quirements concern the drafting of tht'
criminal charge and are of assistance in
determining -when and in what sir=
cumstances a criminal charge might be in-
validated on the . basis of •improper
"pleading" or drafting. Complex rules and
case-law now govern:
- the way in which an .allegation of the of=
fence is set out in the charge document;
- whether certain factual emissions or
failure to :set out matters of la\\ could hi -
validate a charge document:
- whether additional information should
be provided in the statement of the offence
contained in the char.g•e document and
whether the prosecution would be bound to
prove all of t'he.matters set out in that stale -
n. • it of the offence:
- whether charges combining two or more.
offences- within the same docunittnt could be
proceeded upon: and, •
- where certain defects are contained in a
charge document. whether such defects
could be "cured" by, amending the ducu-
rnent so as to rectify the defect.
