The case of Hinz vs, the Usborne
and Ilibbert Fire 'Insurance Com-
pany, tried at the last divisioncourt
in Wilt:ellen, Na711S one of considerable
interest. The plaintiff, August
Hinz, of Lope, claimed $100 under
a policy in defendant company for
injury done to 5 mare, the proper-
ty of the plaintiff, by liehtning in
October 3903. The plaintiff showed
that thero was a thenderstoem
the time complained of and that his
barn was struck, the lightning pass-
ing by an °Pen' window in thestable.
He claimed the mare had been failing
ever since the occurrence and de-
preciated in value more than he.

plaintiff's case, the defendants ,tp-
plied for a non -suit on the ground
that the plaintiff had. not complied
taint the condition of the policy
aa'hich requires notice to be given
within twenty four hours of the
damage where stock is injured or
killed by lightninp', and on the fur-
ther ground that -the plaintiff had
not shown that the horse had actu-
ally been affected by the lightning.
The judge decided against the de-
fendants on both these points, hold-
ing- that the condition endorsed on
policy as to notice in - such cases
was unreasonable mci, therefore, the
Plaintiff wasrnot bound by it. The
defendants called a ntiniber ot wit-
nesses who swore that the plaintiff's
mare was blentished, being lame and
diseased in varions ways. Ms 110nOr
'finally gave 'jtidernent for the plain-
tiff for $10 and costs, saying that
it had been clearly shown that the
inaro waS not valuable, k•aut he was
satisfied she had suffered nervous
ehock as a 'result of the lightnine
and the plaintiff was entitled to re-
cover something therefor.
