Minister of Housing Alvin Curling an- nounced recently that stricter and more extended controls have been placed on all types of conversions, demolitions and lux- ury renovations of rental housing stock in Ontario's larger municipalities for a two- year period. -The government has expended con- siderable time, effort and resources to in- crease the supply of rental housing," Curl- ing said, "At the same time, it is necessary to take measures to ensure the preservation of the rental stock now in existence". Curling introduced the Rental Housing Protection Act, legislation which requires municipal approval of demolitions and con- versions, and luxury upgrading that entails the eviction of tenants. The legislation also prohibits the sale of an interest in a coITunon ownerShip housing venture, such as an equity co-op without the approval of the municipality. The legislation applies to rental com- plexes with more than six units located in municipalities with a population of more than 25,000. However, in all municipalities, municipal approval will be required prior to conver- sion of a rental property to a condominium, regardless of size. Under the legislation, a proposal to con- vert, demolish or extensively upgrade ren- tal housing will be reviewed by the local' municipal council which may approve or re- ject the application. The decision of the municipal council may be appealed to the Ontario Municipal Boa Board, and the board's decision may be appealed to the Cabinet. Curling said municipalities may approve applications where- a building is unsafe; where the applicant has provided housing for the current tenants and provided new and equivalent rental housing ,in the same area; or where the municipal council is satisfied the proposal does not adversely af- fect the availability of affordable housing. Curling said the strict two-year controls "will ensure the protection of ' Ontario's valuable rental housing stock". Meanwhile, Municipal Affairs Minister Bernard Grandmaitre said his ministry will review any proposed land severance ap- plications from municipalities which would enable the conversion of rental townhouses to individual ownership. He noted that municipalities have the power under the Planning Act to approve applications to split up linked housing com- plexes of more than six units, such as townhouse developments, into individual ownerships. "I am requesting that all municipalities subject such applications to especially rigorous evaluation during the next two years," Grandmaitre said. Curling said proposals already underway to convert or demolish rental housing, or to evict tenants due to extensive renovations, can proceed. if aW required permits have already been obtained. Plans to demolish or extensively renovate a rental building could not proceed if all necessary building and demolition per= mits have not been obtained by the time the Act is proclaimed. Curling said any conversions, demolitions or renovations attempted without proper ap- proval would be subject to heavy penalties. "A purchaser will obtain no interest in' the land, and the parties. to such transactions will be liable for financial penalty," he said.
