name has been legally cleared of all

The result of the trial of Gerald SU -
ton leaves a situation complicated in
a manner that is altogether iiniq+'ie in
the annals of crime. It is adtnitted
that it Walter Herbert is guilty of
murder, so also is Gerald Sifton. If
Walter Herbert told the truth. then,
the arch criminal has been allowed to
escape. But by their verdict the jury
that acquitted Gerald. Sifton have said
that Joseph Sifton died as the out-
come of an accident,, and that there
was no murder done. Yet in January
next a mere boy will face a judge of
the High Court of Ontario, and will
hear from his lips the awful words
of doom that shall consign him to the
gallows. And this upon his own con-
fession. He will be taken back to the
cell where he has lingered now many
months, and over him wlil be set a
death watch. And unless the Depar-
tment of Justice shall in the mean-
time interfere Walter Herbert will be
hanged by the neck until he is dead.

AFTER OVER TWO YEARS IM-
PRISONMENT GERALD SIFTON
IS AGAIN A FREE MAN. DE-
CLARED BY JURY TO BE
INNOCENT.
Gerald Sifton is a free man. By the
verdict of twelve of, his peers he has
been declared innocent of one of the
foulest crimes ever alleged against a
citizen of the county of Middlesex.
The verdict that brought to a con-
clefion the great trial and that set
Sifton at liberty was reached within a
few minutes of nine o'clock Saturday
night. The end, like the case itself,
Was full of sensational incident.
Within half an hour of their having
made a declaration to the court that
they could not possibly agree, the jury
a'eturned a verdict of acquittal.
The Crown were surprised at the
outcome. They had expected a disa-
geeement, if not a conviction. The
same case that was laid before a. jury
•fourteen months before had again
been presented it was believed some-
what more
ome-whatmore strongly and effectively.
Fourteen months ago a jury disagreed
upon the evidence, but stood 9 for
.conviction and 3 for acquital.
.An overjoyed defence bad been a
confident defence throughout. To an
equal degree they had built high hopes
upon securing an acquittal, while the
:frown looked for the justification of
their charge against the prisoner. The
defence had on advantage on this oc-
casion that they had not at the first
trial, in that a disagreement was to
them almost as good, in effect, as a
verdict of acquittal. It was well
known that if the jury on this occa-
sion did not convict there would be
no further trial. The Crown would
not make a third attempt. All the
difference to the defence, then, would
fiave been that the prisoner must have GENERAL NEWS

The trial has cost the ` county of
Middlesex many thousands of dollars.
The Crown left no stone unturned in
their efforts to bring home the guilt,
if guilt there was, to the doors where
it belonged. And the task was ex-
ceedingly expensive. The many 'post-
ponements, always unavoidable, it
seemed, were a source of great outlay.
The multitude of medical witnesses
summoned regularly to the trial
just concluded alone cost a snug little
fortune, all told. Probably :115,000
would not cover all the bills that have
had to be met.
Then the expense to the defence
has been enormous. Up to the close
of the first trial, it is stated with
authority, that the expenditure had
amounted to $15,000, while the final
trial;,though much less costly, was
still a very dear affair. Two fine farms
have practically slipped away from
Gerald Sifton as the outcome of the
terrible affair. His own farm of 200
acres is in his name, but it is heavily
mortgaged. And he now comes back
to the world having practically to be-
gin life all over again.
The final trial of Gerald Sifton was
conducted with singular ability. It
needs no special reasoning to persuade
one that the counsel who won back to
liberty a client placed in the position
in which Gerald Sifton was placed
brought to bear an amount of ability
that is almost above praise. By bis
handling of the case, Mr. F. B, John-
ston has perhaps achieved a more
noteworthy victory than all his pre-
vious successors combined. In the light
of what has happened, it is evident:
that Herbert and Sifton would long
ago have been free had Herbert not
entered his plea of guilt.
Then the jury was ..an. able one,
selected from among- the most pro-
gressive farmers of the country. With,
them the Crown and the defence be-
forehe verdict was reached and after
n
were perfectly satisfied.
The presiding judge was officiating.
et his first murder trial ; yet it was
subject for remark among the learned
counsel that His Lordship Mr. Justice
Britton presided with exceptional
skill and ability. Of Crown counsel
little need be said. The leading coun-
eel, Mr. Clute, is a gentleman of the
highest standing in his profession,
and all his resourcefulness was
brought into play on behalf of the
people in this case. That the Crown
Attorney and Deputy did their whole
duty, no one will gainsay.
The closing scenes of the trial will
live long in memory. The last day
was a day of exceptional interest and
of a vast amount of excitement. As
the end drew near, and it was known
that the jury were out the excitement
became intense. Throughout it all
the central figure in the drama retain-
ed a composure that was remarkable,
But later, when removed in a cab to
the home of his father-in-law, he col-
lapsed almost entirely, and bad to be
assisted into. the house.

by the trustee board of the Ventral
Methodist church, Stratford, with
power to canvass for subscriptions and
formulate plans for the purchase of a
new organ and some improvements
and renovations to the church. The
former, it is estimated, will cost in the
neighborhood of $3,500 or $4,000, while
the latter will require an expenditure
of $1,200 or 91,000 The idea is to
raise these sums by subscription. The
committee will consider the matter
and report ata meeting of the trustees.

The latest thing in the Canadian

A wonderful oil find has been just
made on the Scannell farm, Charing
Cross. about ten miles from Chatham,
