The amount received by the defendant from Mr. Penny was $6.150 and for this amount she was sued by the plaintiffs in the action. Some time before his death he consult- ed the manager of the bank in which he had an account as to thero r manner of carrying: out his intention of leaving the money in the bank for the defendant.
