ease of some local interest was. heard
at t'heWoodstock Assizes this week,
It is Brown v. McGregor, an action for
breach of warranty of a horse. In
February and March 1500,
Peter McGregor, of Brucefield, Huron
county, the defendant, entered into
negatiattons with the plaintiff, Wil-
liam J. Brown, of Bright, for the sale
of a horse. The defendant, is alleged
to have warranted the borse as soand,
and promised to deliver him in asouncl:
condition at Bright. On these con-
ditiona Brown was induced to pur-
• chase the horse and gave McGregor
$50 in part payment. The horse was
delivered, but Brown contended that
the animal was - not sound. The de-
fendant dant a sin warranted the horse
g to
be sound, and on the strength of it
Brown paid over $750e and gave his
note to McGregor at one year for $300,
being the balance of the purchase
price, namely 1,100, It subsequently
turned out, according to Brown, that
the horse lead springhalt. Brown
wanted McGregor to take the horse
back and repay the purchase price,
but McGregor said,; "a trade is a
trade,” and hung on to the cash. The
plaintiff alleged that he had incurred
expense to the amount of $350 in keep
ing the horse and endeavoring to in-
duce the defendant to take it back.

the Judge dismissed the case.
