The Master in Chatubere Friday
morning decided a knotty point of law
in the action brought in the interest of
the heirs of Brakeman McHugh, who
was recently killed on the G. T. R.,and
who belonged to Stratford. Lord
Campbell's Act in such cases provides
for compensation to mother, wife or
child. Action was taken on behalf of
the mother, who was an inmate of an
asylum, by a brother. The mother
died shortly afterwards and mean-
while the G. T. R. offered $1,875 com-
pensation. The company now raises
the' point that McHugh has neither
mother, wife nor child and that the
action,jherefore fails. The Master this
mornin7rilecided that unless another
plaintiff can substituted within
a month. the actiola• must be dismiss-
ed.
