Ford Little- to challenge legality of South Storm Sewer

Interest . payments grow as town awaits decision

The to,w n did offer the sub-
dividex' . a break in tax
assessment for the' subdivision
amounting to $2,500 on the
street assessment for the
sewer. They offered-te. remove'""
the tax , and put it under , a
general levy if Mr. Little^would
drop his appeal.
"Council was led to believe I
was satisfied with the tax
break," said Mr. Little,
believe' they were going to
make up the money assessing
land on South Street".

Sewer, told Goderich Town
Council Monday afternoon that
he intended to take them to task
on the legality of the con-
struction of the drain.
He, said he questioned the
validity of the original petition
from the • roads superintendent
in 1968 'recommending that the
drain be installed under the
Drainage Act.
Mr. Little came to council to
ask permission to take the
original petition to the Ontario
Forensic Science Centre for a
handwriting analysis. He said
he intended to check the
validity of the document and
that If council would not relep,se
it, he would get a court order
forcing them to,do so.
He added that the roads
superintendent at that time,
Roy Meriam, had offered—to
testify under oath that he had
not signed the petition and that
he .(Mr. Little) intended to have
the signature checked. .a
Under the Drainage Act a
petition is required signed by
either the majority of property
owners in the area , to be
drained or
superintendent before the
project can be initiated.
Council then passes a bylaw
instructing an engineer to dol.
study on the needs and detail
the size of the drain and its
costs. The project is finally put

Mr. Little told council that lit
the document was not signed by
Mr. Meriam then'. the whole
projects' legality was in
question under the Act. He said
that he did not doubt anyone's
word on whether or not the
document was signed but he
had to verify the matterfor'his
own peace of mind.. -
When he. first learned from
Mr. lVferfain that he cl'ainied he"
had not signed the petition, Mr.
Little went to the town hall to
examine it. He said when 'he
asked town clerk Harold Walls
for it, the clerk briefly looked
for it and couldn't find it. Mr.

Little claims that the clerk,said
that he was not sure if there
was such a document on file.
Mr. Walls told therSignal-Star
in an interview ,,that he had
never seen the petition because. •
it had been,filed away long
before he strted work at the
town hall in 1971. He added that
he was not concerned with
keeping it handy because there
was no need for it unless
someone asked for it
specifically.
"We found it filed away in the
basement where it should be
and it is signed" said Walls.
"Roy Meriam said after the
council meeting Monday that
he had signed the petition."
Mr.Little said he tad ob-,
tained council minutes for the
Months of November and
December and had found no
mention of the petition.
The appeal against the town
was launched by Mr. Little at
the outset of the project. His
fight has' not been without
there was an appeal against the
drain.
The delay caused in issuing
debentures to pay for the sewer
is costing the taxpayer a
considerable amount: The
interest charge on the , loan
taken out by the town to pay for
the sewer amounts to $2,200 a •
month and will not be
eliminated until the debentures
are issued.
A grant given the• town by the
Department of Agriculture is
also being questioned by Mr.
Little. He claims that the
money, about $75,000, was paid

about $9,000 plus litigation fees
that may have to be paid for
