Arthur Nlee n, - Minister of Revenue, will introduce legislation +'hich will lower the rate of tax under the Land Speculation Tax Act, 1974, to Zit per tent; The present .50 per Vent rate of tax is being lowered because of the federl- govern- ment's refusal to all w" -the On- tario Tax as a deduction for federal income tax purposes. Mr. Meen stated in the .House, "I still believe that On- tario is on firm legal ground in its case for deductibility. For ver\ 'pragmatic reasons, however, I do ,not find the ide.a of arguing the point 'through„ the courts very attractive even with the °'vindication• r of dor position. The federal govern- ment could simply amend the federal 'taxa statutes - figuratively with the stroke of a pen - to reverse' the entire pic- ture and disallow the tax as a. deducrtle item. Futhermore, I cannot see putting the tax - wringer for a few more months only to find ourselvesback where °we started." "Accordingly," the Minister continued, "in keeping with our undertaking expressed on,many occasions in tie past that the - speculation ,.tax, when taken together withk—income • and capital gains taxes, would not he confiscatory, I will •be in- troducing today appropriate amendments to the' Land Speculation Tax Act to reduce the rate of 20 per cenf and to provide for the payment of interest on refunds at the rate of 7 per cent." 'When coupled the federal government's position on- non -deductibility,* the -new 20 per cent rate will maintain a similar deterrent force on land :peculators as would have the original higher rate had the .Ontario tax 'het allowed as a deduction for federal income tax calculation.
