Magistrate E. Holmes sentenc- ed Joe Allison, jr., to •five months, Lyle Thurlow, 17, to three months and Fred Molu-Ing, 18, to one month. After their terms expire, all will remain on probation for two years. When evidence was aired at an earlier hearing, witnesses testified that the three teen-agers ,were in a car which cut off another auto, driven lby Donald Glausher, near "the pillars" in Goclerich on January 30. Glousher, who resides hallway 'between Auburn and Myth, was yanked from his car and beaten. One of the three Youths ripped the sitte view mirror off.Glousher's car before they left. According to evidence, Gloush- OTHER , MEANS A corporation which sells whis- key and gin required its salesmen to join clubs "with a view to pro- moting the sale of its brands", it said. In the 1954 taxation year, 17 of its salesmen belonged to 46 clubs; dues totaled $5,988. When it was sought to deduct this amount from its taxable in- come The Department of Revenue disallowed the deduction on the ground that the money had not been spent to gain or produce in- come. The company appealed and testi- fied that its right to advertise was greatly limited and even prohibited in most provinces. Other ways of making its wares known had to be sought. The appeal was granted. From their ruling we quote, "There was an undeniable connec- tion between the efforts of the ap- pellants' salesmen at the clubs and the subsequent sales of products in which the appellant was interest- ed." Defence counsel James Dannelly submitted that the offence was nut exactly what it might appear on the surface. This was "not a wolf patk," he contended. It was a case, he felt, of young men who had money for beer and too much thne 10IT their hands. Feels Attack Planned In sentencing the trio, Magis- trate Holmes stated, "There isn't anything the three of you can say to shake my belief you stopped this car end were ready to beat up the occupants." He termed the offence "really nasty." In announcing the different sentences, the magistrate explain- ed he was considering the past record and general behavior of each youth. "Once you have acquired. a re- cord," he cautioned, "you do not get the same consideration from a court when you later appear." The assault on Glousher was the first conviction against Mohring, the magistrate noted, but Allison and Thurlow had previous court records. Later, hearing two cases arising out of a light at Dunganno,n, the magistrate served notice that he intends to do all in his power to stamp out dance hall rowdyism. "All the rowdies (from around the country congregate at these dance halls," he commented. The trouble -makers spoil it for others who have a genuine desire to dance, he said. Back To Dark Ages The magistrate continued, "It's getting !back to the dim, dark ages when a man ,was afraid to go out at night unless he „had; a body- guard. with Ilim." This, he felt, was a sad com- nientary on affairs in and around The dance hall battlers, Fred R. Vincent and Eldon Lannan, of ,Goderich, (were remanded 'to jail until today for judgment. Lannan entered a guilty plea but Vincent pleaded not guilty. - Provincial Csn_stables P. J. Hen- derson and Ross Balks testified that they saw the pair wrestling on the ,floor at the Dungannon dance hall on February 14 at about 12.30 a.m. After the officers escorted the pair outside, Vincent struck Lan- nan on the jaw, said Constable last blow was that he saw Lannan's man planned to hit him again. So he decided to beat Lannan to it, he said. Expressing surprise at this ex- planation, Crown Attorney H. Glenn Hays asked Vincent why he should fear any harm from Lannan I when there were two husky police officers present. Constable Henderson said both accused men had been drinking.
